Stealing Content Was Getting Harder So Manwin Is Trying To Change The Rules

Times are tough in porn and even the tube sites are beginning to feel the pinch, seems they have stolen about all they can steal and now new content that gets uploaded gets a DMCA request to get it taken down about as quick as it goes up, so Manwin?s tube sites aren?t getting the new content they need to keep it profitable. That pesky DMCA law has become a real thorn in their side.
So now Manwin figures that they can re-write the law with their own rules. Now if you want a video removed from one of Manwin?s tube sites you have to use a specific form one that includes a captcha code and only allows one submission at a time.

This is a clear effort to thwart companies like RemoveYourContent and TakeDownPiracy, who in the past would send a DMCA with dozens of videos at a time that were supposedly ?user uploaded? over the last 24 hours or so. They would email it to the copyright email address and Manwin would have to remove the offending posts. This was starting to put a hurt on the traffic, because the new content was being removed as quickly as it went up.

If you want to remove stuff from Google you use a form, if you want to remove stuff from Tumblr you use a form with Captcha, if you want to remove stuff from Yahoo you also use a form with Captcha.

Regardless, "WHO FUCKING CARES" should be you. People used to blame the economy AND tube sites for drop in sales but now it appears that tube sites are more and more to blame. Your sales, whatever they are, are at the very least partially reduced by tube sites, and even more by illegal tube sites. Business for content providers has also become tougher because models are becoming concerned about the inability to effectively have content removed by these sites. It is a serious problem that deserves your attention.

If you submit 100 videos that you own 100% - many of them will be removed in 30-60 days because of false positives and false reports. Take down services all work very poorly and use automation to flood tubes with DMCA requests, a great deal of which are not valid.

Tubes have absolutely no negative effect on my business, but then again as I have said time and again, I sell the perception of something that cannot be gotten for free. Actual content is the lowest common denominator in this business.

Interesting question the more I looked into these guys, particularly the Panamanians the more I found companies like Armitech (ex KGB arms dealers) the more i got into that the more I realized I wasn't going to chase that shit down....i turned over what I had to the proper persons and left that leg of it alone....sometimes discretion is the better part of valor ya know.

im no attorney but i dont see anything in the dmca law that says you are required to take complaints by email.

i might be wrong tho

just because most companies take them by email does not mean you have to.

A great deal of time of time is spent verifying tube links. Take down notices would be sent much quicker if there was not time spent making sure something is the right movie.

if a email address is a auto responder then i have received nothing because its not a valid email address that accepts emails.

i have no dog in this fight but what they seem to be doing im pretty sure is 100% legal

neither am I, but when the US copyright office wrote this:


"The limitations on liability established in this subsection apply to a service provider only if the service provider has designated an agent to receive notifications of claimed infringement described in paragraph (3), by making available through its service, including on its website in a location accessible to the public, and by providing to the Copyright Office, substantially the following information:

(A) the name, address, phone number, and electronic mail address of the agent.

(B) other contact information which the Register of Copyrights may deem appropriate."

they didn't ad in "but those things don't actually have to work".

and when they wrote this:

"A notification of claimed infringement must be a written communication provided to the designated agent of a service provider"

they didn't ad "the notification must be delivered via the infringing parties preferred method of communication"

I don't really think there is anything wrong with the fact they are using a form, for some people it might actually make the process easier, but they still have an obligation to post an email address and accept submissions via that address.

Could it be considered anti-competive behavior in their jurisdiction if they run a competing service (Degban) which isn't subject to the one per form with captcha limitation?

RYC and others might consider looking into a captcha breaking service. I've seen some with 85% accuracy for as little as about $5 per 1000 captcha. You can automate it. It's ridiculous but it would probably work until the scumbags do something else to make it harder for people to remove their content.

I think almost everyone agrees the DMCA is fucked up and it has serious holes. It seems like it was created only to protect the big mainstream players as a sort of compromise with little regard for everyone else.

I have him on ignore but someone quoted him. It's funny to see The Squealor guy constantly in every thread like this chastizing people for bitching when what is he doing?? Bitching about people bitching. Follow your own advice dude.

I'm not a programmer but I think it would be somewhat easy for one to code a system that would take the form data and split it up across multiple "batches" while using a service like
http://decaptcha.biz/ to type in the images for you. Kinda like what spammers do to auto create millions of free email accounts they use to send email with.
