Unauthorized Use of Yahoo! Inc. Properties - flickr-chicks.com [Case #19923]

Dear Sir or Madam:

This letter is being written to you on behalf of Yahoo! Inc. (?Yahoo!?). Yahoo! is the exclusive owner of all trademark and other intellectual property rights in and to the FLICKR trademark (the ?Trademarks?), including the stylized FLICKR logo. Yahoo! owns trademark registrations for the Trademarks. Yahoo! uses the Trademarks in connection with, among other things, its search engine services and online messenger services, and these marks have become firmly associated with Yahoo! in the minds of the public. Based on the foregoing rights, it is a violation of federal and state law for others to advertise, utilize, offer for sale, and/or engage in services in connection with the Trademarks without the express written permission of Yahoo!.

It has come to our attention that you have registered the below listed domain name(s) and are operating an active website at such domain name(s) :

flickr-chicks.com

Your selection and use of the aforementioned domain name(s) creates the impression that your website is an authentic Yahoo! website, when in fact it is not. The Yahoo! name and mark is fanciful and strong and entitled to a broad scope of protection. There is no other reason for registering a domain name incorporating the Trademarks other than to trade off the established goodwill in the famous name and mark YAHOO!. Consumers are likely to be confused that the domain(s) is somehow associated with or sponsored by Yahoo! when it is not.

Your use and registration of the famous YAHOO! name and mark constitutes counterfeiting as well as infringement of Yahoo!?s trademark and service mark rights in violation of the Federal Trademark Act, 15 U.S.C. § 1051 et seq. and constitutes common law trademark infringement and unfair competition under state law. Your actions are also in violation of the Anticybersquatting Consumer Protection Act, 15 U.S.C. § 1125(d). Accordingly, you may be liable for up to $100,000 per domain name registered.

We therefore demand that you immediately cease and desist from infringing Yahoo!?s intellectual property. To that end, you must:

1. Immediately deactivate the website located at:

flickr-chicks.com

2. Immediately take all necessary steps to transfer to Yahoo! the above domain name(s), including:
(a) Unlocking the domain name(s);
(b) Providing us with the authorization code for the domain name(s); and
(c) Subsequently executing any emails or other documents to effectuate the transfer.

3. Immediately cease using the famous name and mark YAHOO! and any other intellectual property
owned by Yahoo! or any other intellectual property confusingly similar thereto on any other Internet web sites that you run, or otherwise in connection with your activities.

The demands herein are not made to the exclusion of other rights or remedies to which Yahoo! is entitled, and nothing in this letter, nor any act or omission by Yahoo!, shall limit those rights or remedies, all of which are expressly reserved.

Very truly yours,

Global Brand Protection, Yahoo! Inc.

You are using their trademark. You have no choice but to comply with whatever they say. You can't use other people's trademarks.

Consider yourself extremely lucky that they are letting you off easy with just taking your domain name from you. They could have gotten a quickie $150,000 judgement against you AND taken your domain names.

very easy: you take a risk. One means to lose 10 bucks or so. The other $100,000 plus legal costs. Do the math.

Just take it
Comply, apologize and back out slowly and be very polite
I bet you don't make enough money from that site to even pay for one day of legal advice or a day in court trying to defend it. Let it go!

You are in fact using their trademark, let it go, they win, leave it at that.

Just ask for a confirmation, like a phonecall, a name of their manager and how to contact them. As long as it's real, comply.

I don't care about the blog. I just don't know what to do...Delete it? Then what? Just redirect the traffic? The domain expires in a few months anyway.

You need to read the e-mail again. It's says delete the site, and immediately transfer the domain to Yahoo.

I got this one, took down the site and sent traffic to a cam site till the domain expired.

Re: Trademark Infringement By <-----directv.com>

Dear ------ --------:

I write on behalf of DIRECTV, Inc. (³DIRECTV²), to demand that you immediately stop all use of the above domain and transfer it to DIRECTV. As you know, DIRECTV is America's leadingsatellite TV service offering over 265 digital channels to over 50 million viewers. The company distributes and installs satellite TV dish receivers, tuning boxes and other products and services related to the delivery of high quality digital TV service. DIRECTV promotes and sells its services and products through its websites, such as www.directv.com, which incorporate the DIRECTV trademark.

DIRECTV has used its DIRECTV trademarks since at least 1994 and this trademark is the subject of many trademark registrations around the world. These famous trademarks have come to be associated exclusively with DIRECTV in the minds of consumers.

Without the permission of DIRECTV, you own the domain name <kcdirectv.com> (the ³Infringing Domain. This misuse of DIRECTV¹s trademarks constitutes infringement of such marks in that it creates a likelihood that internet users will be confused and deceived as to your affiliation with DIRECTV. Your use thus constitutes violations of both domestic and international trademark law. Furthermore, if you are a DIRECTV Retailer, you are in violation of Section 9(f) of your Independent Retailer Agreement.

DIRECTV demands that you immediately cease and desist from any and all use, advertisement and display of any domain name or web address which includes the string ³DIRECTV², or a similar string such as the Infringing Domain, and that you transfer the Infringing Domain to DIRECTV.

Demand is also made that you or your legal counsel contact the undersigned in writing, within Five (5) calendar days acknowledging that all commercial activities with regard to the Infringing Domain have been terminated, that you unlock the Infringing Domain and that you provide us with a transfer authorization code so that we may undertake the transfer of this domain to DIRECTV.

Should you require evidence that we are authorized to represent DIRECTV, Inc. in this matter I invite you to click on the following link which shows past enforcement actions we have taken for this client (click on any of the most recent ³Transferred² buttons and then see the undersigned¹s name listed in the ³Parties² section at the top of each arbitration decision):

http://www.udrpsearch.com/search?que...search=parties

I look forward to your prompt reply.

Very truly yours,

Of course its real. The WHOIS is Yahoo.

You're clearly infringing on their mark. No way around it.

No different than if you created a site called facebookgirls.com.

Do as they say or they'll do it for you and they'll make you pay for your infringement.

You should be getting a registered letter by snail mail shortly.

I got one when I registered MissUniverseCrotchShots.com.

Let's just say that they now own that domain.

Ask for money and see what their response is...

I would put up a blank page on flickr-chicks.com right now!
I would unlock the domain name and provide the with the authorization code
I would change the name on your website/get a new domain name.
I would do this all ASAP

Sissy. Just copy the actual flicker logo and add it to the top of your site. Intimidation is a bitch.

write back and tell them to suck your dick. If they take your house away, you'll know it's not a scam.

If you're so stupid that you need to ask 'what to do'... then i'd suggest putting a gun in your mouth and pulling the trigger because quite honestly, life just isn't for you.

First, Contact Yahoo and make sure that the email is legit.

Assuming it is, hire a lawyer. Not to fight it, but to LEGALLY shut the domain down or transfer it to Yahoo, and then DECLARE that you have done so to them, and then request confirmation that it has been done to their liking. You don't want to get sued for doing the right thing but failing to report it properly.

Mishandling C&D's can be expensive.
