I write on behalf of DIRECTV, Inc. (³DIRECTV²), to demand that you immediately stop all use of the above domain and transfer it to DIRECTV. As you know, DIRECTV is America's leadingsatellite TV service offering over 265 digital channels to over 50 million viewers. The company distributes and installs satellite TV dish receivers, tuning boxes and other products and services related to the delivery of high quality digital TV service. DIRECTV promotes and sells its services and products through its websites, such as
www.directv.com, which incorporate the DIRECTV trademark.
DIRECTV has used its DIRECTV trademarks since at least 1994 and this trademark is the subject of many trademark registrations around the world. These famous trademarks have come to be associated exclusively with DIRECTV in the minds of consumers.
Without the permission of DIRECTV, you own the domain name <kcdirectv.com> (the ³Infringing Domain. This misuse of DIRECTV¹s trademarks constitutes infringement of such marks in that it creates a likelihood that internet users will be confused and deceived as to your affiliation with DIRECTV. Your use thus constitutes violations of both domestic and international trademark law. Furthermore, if you are a DIRECTV Retailer, you are in violation of Section 9(f) of your Independent Retailer Agreement.
DIRECTV demands that you immediately cease and desist from any and all use, advertisement and display of any domain name or web address which includes the string ³DIRECTV², or a similar string such as the Infringing Domain, and that you transfer the Infringing Domain to DIRECTV.
Demand is also made that you or your legal counsel contact the undersigned in writing, within Five (5) calendar days acknowledging that all commercial activities with regard to the Infringing Domain have been terminated, that you unlock the Infringing Domain and that you provide us with a transfer authorization code so that we may undertake the transfer of this domain to DIRECTV.
