To all the law experts in GFY....

The recent news on the 2 Swedes who got the verdict of life imprisonment for human trafficking, what if the "victims" came out and confessed that they worked out of their own free will, can the verdict be reverse?

Very rarely does the victim have a say in something like that. It isn't "you broke the law if your victim agrees", it's "you broke the law."

No. Reversal works only on technicalities, lawyer mistakes, or judges mistakes. A remission or admission of guilt doesn't change the outcome that's already became official.

You are usually only charges with "human trafficking" in the Philippines (when porn is involved) when you have minors involved.

Each count of human trafficking was more than likely 1 count per minor.

That means, they got caught working minors. More than one. It doesn't have so much to do with working against their will, even though that was added to pile of shit that was tossed at them.

The biggest mistake they made was not paying whatever it cost, on the spot, to be allowed to flee.

98% chance they will die in a Philippines prison. But... it is the 3rd world so *maybe* they can still grease their way out.

In Florida if a partner refuses to prosecute a domestic violence incident the state automatically becomes the victim and presses charges ..... Do you really think a third world country will drop charges when a MINOR changes her mind?

Child pornography, whether the child (a minor person) is forced, coerced or is a willing participant is illegal in most countries. Not only is it illegal, if done knowingly it is morally reprehensible.

What if you can prove to the court, that the minors actually fooled the 2 Swedes into allowing her to work ( it is a very common practice ). If the cam site could be fooled, don't see why the 2 Swedes can be too.

I was told some of the minors are 17 and single moms. I know the court doesn't give a fuck about the logic of it is ok to have sex with a local guy when you are below 18 but is a big no no if you get naked in front of the camera.

It doesn't work that way in the 3rd world, especially in Asia.

There is money. There is who you know. There is timing. There is face. There is your competitor.


That's it.

They blew three of the five when they were arrested. Be it they didn't have enough cash, know the right person, or the timing was wrong. Whatever the case, they were not able to get out of it, and it stemmed from one or all of those reasons, with the latter being something as simple as their competitors simply paid more money to the police to make sure the Swedes went away.

This is how you play in the 3rd world. It's not fair, but you often stand a chance if you've played your cards right. They didn't, or the person who sold them out had more money or influence over the law.

3rd world justice. They should be lucky they were not shot in the head by the very police who came to arrest them.

In the Traci Lords incident, which was the incident that gave cause to the original §2257 statute — Traci Lords was 15 and obtained a Sate of California Driver's License with her older sister's birth certificate. She used that falsely obtained license as "proof of adult age" to appear in porn films. When the truth of her age came to light there were legal actions that in the end resulted in only the confiscation of all VHS tape inventory ( this was in the 1980s ). The video producers, having accepted this state issued ID unknowingly, were released of criminal culpability.

Of course this was in the United States and this was a one of a kind incident. The producers were not involved is some pattern of child pornography. The Philippine authorities found that the convicted Swedes where guilty of two counts of "human trafficking" involving two separate minors.

From my own viewpoint, as part of the adult webcam broadcast industry, these men were jeopardizing our lawful standing to produce content with adults for adults and further jeopardizing us as child pornographers. They are now unable to do any further harm. I know of one person (American) that did some large cam studio business in the Philippines, in time he was arrested and deported from the Philippines. However, he was careful enough not to employ any minors.

Sexual consent and statutory rape laws have no relevancy in child pornography. Private sexual intercourse and performing on an "adult webcam" are legally two separate issues.

In 1996, 492 of 3,776 reported cases of child abuse involved pornography, prostitution, paedophilia and trafficking. There were 8,335 cases of child abuse from 1991-1996, 96% of the victims were females. Philippine women are vulnerable to trafficking due to the Asian economic crisis. Requests for entertainer visas for Japan did not decline in the first six months of 1998. Travel to Japan increased 21% in the first half of this year compared with the same period in 1997. The label "entertainer" sometimes implies "sex worker." The women are vulnerable in Japan, not because they lack skills, but because they are young, beautiful women in a hazardous or vulnerable occupation. Trafficking laws exists but are not enforced. Case

Four Chinese women suspected of being prostitutes were arrested by the Manila Police in a karaoke bar. The club manager however, was not arrested. One of the arresting officers is accused of raping one of the apprehended women. These arrests brought the number to 23 Chinese women found to be working as prostitutes in Manila clubs alone. Policy and Law

The Philippine government emphasis on labor export to support its balance of payment deficits has contributed to the trafficking of Filipinas to Japan. 3/4 of the trafficked Filipino women surveyed by IOM were repatriated to the Philippines after being help in prostitution, suffering from various health problems. In 1995, the national government in Manila appointed a special prosecutor, Dorentino Floresta. In his first year, 181 people were prosecuted for sexually exploiting children. Prostitution

Child prostitution is a serious social problem in Thailand. Prostitution is a form of enslavement that currently involves perhaps 800,000 children under the age of sixteen, bought and sold for a profit that exceeds that of the drug trade or weapons sales or lotteries or sports gambling.

The Thai culture has a long history of prostitution but the problem has never been as grave as it is at present. Prostitution has been a way of life in Thailand from time immemorial, and has not been considered an evil by Thai society. There are numerous stories of brothers and sisters crying and dying in pain, with the loss of all hope. We have countless stories of their suffering loneliness, illness, misuse and imprisonment in filthy airless rooms. In August a senior Thai health official said that AIDS had become the main cause of death in the country. I have to carry out a lot of funerals, so I know this is true.

Ya, i just don't get why anyone is talking about Thailand and prostitution and AIDS when the issue we are talking about in this thread is about the Swedish guys being sentenced to life in prison in the PHILIPPINES

..... sorry, I just don't see where the connection is being made

in Thailand u can keep that window open at least a couple of weeks if your embassy lawyer can convince the police that money is coming. but money has to come from outside the country, because anything you had inside the country was split up among the raiding police 10 minutes after they busted down your door.

Laws are man made....if I am the judge, I would be more tolerant and take it into consideration while passing my judgement. ( taking the 17 years old single mom here as an example ). My argument here is the verdict is just beyond crazy.
