Ok, this thread is about content, licenses, 2257, legal issues for newbies or veterans.

That came naturally when my GF (who's hobby is photography) was making me horny when I just woke up in the summer and went outside in the garden for my morning coffee
And she used a filter on the pic somehow

I have a question actually.

I am Canadian, I am a non-resident but I am not a resident of any other country either as I travel too much and do not spend enough time in any one place. My website is hosted in Canada. Does this mean I'm governed by Canadian laws? Adult laws are different in the US and Canada so I want to make sure. I picked a Canadian host on purpose for this reason but I want to be sure as I am officially a non-resident.

Also I know as a Canadian I do not have to comply with 2257, so if I choose not to does this mean that affiliates who are American can not legally promote me? And if this is true, and I choose to voluntarily comply by having my personal ID/documents somewhere, can they still promote me, with my images only, if on my website I also have models with me whom I do not have documents for?

If you host in Canada you fall under Canadian law I think for the website part (depending where you are incorporated where your domain is registered.)
US based affiliates have are bound by US law, which is different.
So this is a conflict.
So my advise would be, in order to get the max. out of your US affiliates and reduce any risks, you should fully live up to the 2257 laws.

I'll mail your question to 3 Canadian people in this business and see if they have more info on the question you aksed, which was an interesting one

If you are a US company but do all your work abroad, do you have to have a US based custodian of records, or can you place your custodian anywhere you want?

BTW, is this just for legal type questions or are you also answering questions about content production?

Thanks I have no problem having my stuff available but there are some girls I know would have a problem with it, friends, whom I'd like to shoot with. I can easily put them on the site and not in the content I give to affiliates but I'm not sure if that is okay or not.

There are numerous DVD studios/producers that have a custodian of records mentioned on the DVD packaging in other countries then the US (otherwise they cannot export the DVD's to the US that are made in other countries).

What do you want to ask about productions? Let's see if I could be of help there too.

what exactly do they have a problem with ?

You are not publishing their personal data on your site free for everybody to see. It's just a text line that says you store the records.
You need to keep the original documents safe if any government agency ever ask for it or if there is a legal issue as formerly your friends have not given you a written permission (modelrelease) so if they ever stop being your friend you could have a problem also if they mean you harm (I assumed you procuced it).

Actually your threads in the Webmaster Q&A inspired me

On the main fucking around there is so much drama, hate and nonsense it might scare new ambitious people away with serious and simple questions that are common knowledge for some but not for all.
Everybody has to start somewhere and some of the new people will grow to be industry leaders in time and some will fail or just give up.

Answering questions to people in the Q&A section without being rude I found rather nice inspiring.

Mutt advised me a shopping cart in 2003 which I tried then but still use in 2009. That was a solid advise. I thanked him in another thread this week for his advise in 2003.

Did you ever knew the copyright on the DVD cover is not always the same as the video scenes on the DVD ?
A photographer holds the right to the pictures and the camera man of the videos (which could be different cameramen). These people "sell" their copyrights to the Studio/publisher.

Did you know there was copyrights on subtitles from the translator too ?

I am not a US based legal advisor
I am a content broker from the Netherlands.

But I rarely see a (blog) site with a warning page these days.

Ok. But if your office is outside the US, you produce everything outside the US, and you don't sell/broker any content to anyone in the US, do you even need to comply with the US record keeping requirements?
