Send them a cease and desist right now. Tell them they are not allowed to contact any more of your customers or they will be sued. You say the list is stolen, let Acacia know that they are using a stolen customer list and tell them to stop using a stolen list, now or they will be liable for any damage they do to your business from this time forward. if I had to guess, Id bet they sold that database to another company and they double crossed m*trix and sold it to Acacia. Now m*trix feels like they just got kicked in the nuts and have to figure out their next move.

You can't just keep using stolen property because you didn't know it was stolen when you got it. You also aren't absolved of responsibility when you buy stolen property and then use it.
What if it was a stolen credit card list, could you just keep using the credit card numbers because you didn't know it was stolen? This is all assuming the list is really being used illegally, which we are being led to believe. |

I'm not buying that the list was stolen, if it was they'd take legal action which I'd be willing to bet they won't do. They obviously gave away their DB as a part of their deal, and now that people are calling them on it they're using the good old reliable "hacked or stolen" excuse. Prove me wrong Matrix, sue them.

Has Matrix actually agreed that the list was stolen & not given to Acacia? Because I'm sure Acacia wouldn't like it if Matrix was running around saying Acacia is using their stolen list witout permission if Matrix did in fact give them permission. More drama to consider. Yeah I agree with the the thread starter. Matrix needs to take action and start with a C&D to save a little face with their clients. :2 cents: Then the defense team will probably be able to use the tale of this C&D request to Acacia in their defense. :1orglaugh I still think that Matrix is innocent and the list was probably stolen from them long ago. |
If it was stolen, which I'm not sure, it was in the last 4 months, only 1 purchase from Matrix, and a letter with the info I used on their site. They either Gave (sold) the list or it was stolen in that time frame.

Like Basschick says, if Matrix didn't give Acacia their list they should take them to court. The evidence is overwhelming that Acacia is using info only given to Matrix, which many people can prove. Either Matrix gave the list or it was comprimised. Matrix should either admit it or do something about it. All I see from Matrix is "prove that it is our list." Which to me smells like they are trying to be clever and not accept culpability. If the list was given to them, fine tell us, we will deal with Matrix in the biz area, if the list wasn't given to them on the up and up, Matrix can do something about it by pursuing Acacia through legal channels.
The real sad part is Matrix has great content, but why would anyone in their right mind want to buy from them if they won't protect their customers. This biz has alot of integrity, believe it or not, but everyone that runs a tgp, link list, or even just submits galleries knows all about cheaters, if you cheat you are blacklisted. So you run an honest operation, you don't cheat, if you are cheated you do something about it. |
If the list is stolen, Matrix should be taking Acacia to court for theft.
If the list wasn't stolen, Acacia should be taking Matrix to court for damaging their business by implying Acacia stole it or knowingly buying a stolen list. Neither are going to happen. We're dealing with a bunch of less than honest people on both ends. Have you no memory folks? Since when is Matrix so squeaky-clean? Can anyone say Babenet? |
