Get your lawyers on this now.

Send them a cease and desist right now. Tell them they are not allowed to contact any more of your customers or they will be sued.

You say the list is stolen, let Acacia know that they are using a stolen customer list and tell them to stop using a stolen list, now or they will be liable for any damage they do to your business from this time forward. They should also know that there may be criminal charges if they continue to use a list they know is stolen.

Do it right now.

LAS VEGAS - A man said to have offered a "valuable customer list" purporting to be a CE Cash e-mailing list was issued a temporary restraining order August 8.

A federal judge handed down the order against Eric Suchomski, known also as BigMike9712, after Suchomski reportedly offered the list for sale on a popular adult Webmaster chat board, according to R.P. Ventures attorney David Steiner. R.P. is seeking over $1 million in actual and punitive damages against Suchomski.

The order bars Suchomski from selling, disbursing, or any other dissemination of any e-mail addresses actually or allegedly belonging to R.P. Ventures, whether or not it's identified as a CE Cash list. It also bars Suchomski from accessing any computer systems housing these lists. A heariing on R.P.'s preliminary injunction motion is set for August 13.

"This property is valued in the millions," said an unidentified R.P. spokesman, "and we will continue to prosecute this matter and any individual found trading or using our customer list to the full extent of the law." The purported "CE List," as Suchomski was said to have trumpeted it on the message board in question, reportedly contained 12 million e-mail addresses.

Reached for comment by AVN Online, Steiner said the temporary order was granted the same day the case was filed, just days after R.P. learned of Suchomski's message board postings.

They should stop Acacia from contacting anyone on that list until a judge determines what happened and how Acacia ended up with a stolen customer list.

Also, Acacia should be barred from using any of that information and if they do, they should be held accountable.

Acacia is trying to use the legal system against the adult industry, now it's time to use the legal system back against them.

If this list is really stolen, then Matrix can go after Acacia and hurt them.

It would be too easy for Matrix to say the list was stolen or they got hacked. That's just an easy excuse to dig themselves out of this hole. IF Norman comes back with this excuse and does not take legal actions, then we know it was all BULLSHIT.

if I had to guess, Id bet they sold that database to another company and they double crossed m*trix and sold it to Acacia. Now m*trix feels like they just got kicked in the nuts and have to figure out their next move.

Honestly I think anyone selling lists of their customers must be beyond greedy.. I'm not saying this is what Matrix did, because I can't prove or disprove that.. But I would rather close up shop than sell my webmaster list. And I don't care what anyone threatens me with.

You can't just keep using stolen property because you didn't know it was stolen when you got it. You also aren't absolved of responsibility when you buy stolen property and then use it.

What if it was a stolen credit card list, could you just keep using the credit card numbers because you didn't know it was stolen?

This is all assuming the list is really being used illegally, which we are being led to believe.

I'm not buying that the list was stolen, if it was they'd take legal action which I'd be willing to bet they won't do. They obviously gave away their DB as a part of their deal, and now that people are calling them on it they're using the good old reliable "hacked or stolen" excuse. Prove me wrong Matrix, sue them.

Has Matrix actually agreed that the list was stolen & not given to Acacia?

Because I'm sure Acacia wouldn't like it if Matrix was running around saying Acacia is using their stolen list witout permission if Matrix did in fact give them permission.

More drama to consider.

Yeah I agree with the the thread starter. Matrix needs to take action and start with a C&D to save a little face with their clients.

Then the defense team will probably be able to use the tale of this C&D request to Acacia in their defense.


I still think that Matrix is innocent and the list was probably stolen from them long ago.

If it was stolen, which I'm not sure, it was in the last 4 months, only 1 purchase from Matrix, and a letter with the info I used on their site. They either Gave (sold) the list or it was stolen in that time frame.

Like Basschick says, if Matrix didn't give Acacia their list they should take them to court. The evidence is overwhelming that Acacia is using info only given to Matrix, which many people can prove. Either Matrix gave the list or it was comprimised. Matrix should either admit it or do something about it. All I see from Matrix is "prove that it is our list." Which to me smells like they are trying to be clever and not accept culpability. If the list was given to them, fine tell us, we will deal with Matrix in the biz area, if the list wasn't given to them on the up and up, Matrix can do something about it by pursuing Acacia through legal channels.

The real sad part is Matrix has great content, but why would anyone in their right mind want to buy from them if they won't protect their customers. This biz has alot of integrity, believe it or not, but everyone that runs a tgp, link list, or even just submits galleries knows all about cheaters, if you cheat you are blacklisted. So you run an honest operation, you don't cheat, if you are cheated you do something about it.

If the list is stolen, Matrix should be taking Acacia to court for theft.
If the list wasn't stolen, Acacia should be taking Matrix to court for damaging their business by implying Acacia stole it or knowingly buying a stolen list.

Neither are going to happen. We're dealing with a bunch of less than honest people on both ends. Have you no memory folks? Since when is Matrix so squeaky-clean? Can anyone say Babenet?

Welp since nobody asked me.

I think this whole concept of a stolen list is total bullshit.

Matrix is small, have no bankroll for major legal messes, and if they were offered a deal, it is my opinion they took it.

They had to make a decision between going belly up and driven out of business because of Acacia or do what they had to do to get thru this and earn a living.

I mean, shit...think about it, if it were you, you would have done the same thing.

Who ya bullshitting here.

LeeNoga I disagree with you. Not everyone in the biz would do that and I would rather shutdown my content site before I did a deal like this with Acacia.

but lee, we don't know that's what happened. maybe the database of registered webmasters really WAS stolen, and if that's the case, they might even find help with a legal fund right here by letting us know.

if acacia is using a stolen list, they should be stopped, as should anyone using stolen material. also it makes people think less of matrix to think they gave away our info and then lied, so if they didn't, this is an opportunity to quiet all doubters. if matrix is not telling us the truth, we deserve to know who gave away our personal information. that simple.

IMHO appears that Martix rolled over, and is trying to out a band aid on the situation. Guys behind Matrix have real $, and if Acacia is using said list, they could do something about it. Of course, unless they gave it to them.

*Assuming* a portion of the list of names (probably compiled from multiple sources) came from Matrix Content, I will bet it was NOT stolen, but more likely GIVEN to Acacia by Matrix Content as part of their settlement with them.

Don't expect Matrix Content to admit nor deny this; they may even lie, since Matrix Content likely signed a NDA as part of their settlement...it may very well take court action to get the truth.

With that said, the real battle now is not with Matrix Content, but rather with Acacia...in the meantime, one does best in my view to AVOID all companies/sponsors that settled with Acacia and sold out the adult community.
