It was the Appellate level. This has nothing to do with judges milking it, they have nothing to gain. There are limited judges and tons of cases. Seven years is not bad from start to finish.

Congratulations, if the Federal Appellate Court affirmed the lower court's ruling summarily ? I'd call it a slam-dunk. Hopefully, this decision may set some new precedent however the next case is probably de novo.

Unfortunately, frivolous lawsuit countersuits are very rare in patent litigation and there is very little chance that Disney and others would counter-sue in spite of the ruling. The original judge basically already shut that sort of thing from happening down anyway. And that is for the entities that didn't settle... anyone that did settle would have even less recourse since they basically already agreed that the patents did cover them when they signed on to licenses. Regardless, even if they did sue then it would not have any sort of practical or helpful benefit to any other companies that paid off.

We all wish we could have our money and our seven years back but that is not going to happen. Acacia does have to cover some fees but not much else. Still, I feel that the precedent we set for other companies that might want to try something similar is clear - DON"T TREAD ON US.

That sort of resilience is priceless.
