I mean wtf? Some of the big names - NaughtyAmerica, Nasty Dollars have tons of their content on there as well as just about every other site.

So, is that how you get in the biz.

1. Buy Clip Share
2. Buy some memberships to paysites and rip the content.
3. Ask Seg Pay to process.

This is way to easy.

Do Something Segpay

Segpay has shown a tolerance for illegal tube sites. Its time for them to stop or get sued. Safe Harbor does have its limits.

Our Compliance Department is working already on it. Webmaster had removed videos that were questioned. If you see any others, please email links to [email protected] or [email protected] and Segpay will make sure all of them are removed from that website.

You are correct that some were removed, only to be uploaded within 12 hours later. At what point is enough enough?

Have you been ever remotely proactive on this and checked to see if any of the other 1,000s of videos are used legally? Checked to see if the webmaster is 2257 compliant or is in compliance with Visa regs?

Some of those boys look really young.

perhaps the best course of action is to go directly to segpays merchant banks. demonstrate that they are not following visa guidelines. it would suck for legit business that process with them if segpay lost their ability to process, but at least that would remove one more shady processor.

Segpay, you can not continue to process for pirate websites and say well they removed the videos when you sent the dmca's. It is clear this site is using illegallly obtained content. its clear their entire site is like this. stop processing for tube sites. plain and simple. I guess you will not learn until you are slapped with lawsuits. Anyone that is processing with Segpay I urge you to stop processing with them, as it would just suck to wake up one morning and your processor is shut down.

Hi, I don't like the current laws any more than you do but to keep your service provider status you absolutely are not allowed to be proactive on any of it. DMCA has a process, all you can do is follow it and lobby to change the law.

It should be the webmaster has been told if any more pirated content is found they will lose their processing. The most militant christian is not half the enemy to this industry as it is to itself.Very sad.

True. MOST processors do that. Safe Harbor has limits and there is a clause about "repeat infringers"

But the child porn would put a nail in the coffin for most processors.

I think the host is a little bit more responsible than the billing company.... I see the whole thread you send 'messages' to segpay but never talk about the host. Are you working for a competitor of segpay or something like that?

Thank you to all the folks that sent over the DMCA?s. SegPay takes copyright infringement very serious. We are taking the appropriate steps now to terminate this merchant from the SegPay portfolio. In the interim, they have also been told to remove all illegal content.

No. It's my fucking content that gets removed and put back up. DMCAS get sent to Host, SegPay, and the webmsater.

No. But, and you can correct me if you feel differently, I don't think a site that is all stolen content should have the "luxury" of being processed by a processing company when they also have videos of 16 year olds on the damn site. And how would you feel when you went to the site to get links to send out yet another damn DMCA and your video was right next to a video of a 16 year old kid. I puked.

Not quite. I haven't clicked through yet but I am assuming this is a tube that accepts user uploads. The most any billing company should do is what they already seem to be doing, make sure it is taken down when the proper channels are used. They are not in the business of verifying claims made by others.

No, you should do everything you can to make sure the law is updated to something that works. As the law stands, you send DMCA and they remove or say no. They say no you can sue.

lol. There are so many wanna be board lawyers it cracks me up. Why don't you go create a tube site with all your "legal" expertise and let me sue the fuck out of you. (For the MOST part when a tube site accepts payment via an ISPS they can pretty much toss out any and all safe harbour protection they have.)
