didn't have a chance to look at the site but I did notice that they are registered with domain privacy at namecheap

you could contact namecheap and bring it to their attention and see what they say about it

i saw that so i sent them an email. this is what the uploader had to say. this gives you a good idea what we're dealing with:

"the win" would be if namecheap cut them off.... I believe it happened to another domain that was blatantly running a content theft site and registered at namecheap last year that came to GFY's attention and was down within the day when a number of gfy'ers contacted namecheap and the hosting company (fill in the details anyone that remembers that when it happened here last year)

now that I think of it I believe it was the hosting company that pulled the plug on that one that was on gfy last year, it turned out to be some 17 year old kid living with his parents that saw nothing wrong with setting up a website full of stolen content

i just got a reply back from namecheap and they said they can only provide the customers info and host by court order.

so basically if someone starts a tube site full of stolen content, all they have to do to prevent getting a DMCA from the content owner is use WhoisGuard?

brought this up with our chief counsel, and she said by not providing contact information for a DMCA, they expose themselves for going right to court, so you can get a court order and then namecheap will have to cough up the info=)

Um technically no. Should check with DMCA, safe harbor, and say registered agent.

ASM is correct.

They are wrong, and basically can now be sued by not following DMCA. Once you hit them with a DMCA, they have to investigate, remove, justify or counter with reason for refusal.

If they refuse (based on your limited info), that is basically a lawsuit waiting to happen. If I were NC, I would fire my attorney.

Oh man, here we go again. You can send the site DMCA's until you are blue in the face and they can wipe their asses with them. They are hosting the images on an image host like Image Venue, and they are hosting the content on Rapidshare, File Factory, and a number of other file sharing sites. It is not a tube site, so if you want to send a DMCA and get your content removed, send it to the image host and the file sharing site...
