ASM is correct.
They are wrong, and basically can now be sued by not following DMCA. Once you hit them with a DMCA, they have to investigate, remove, justify or counter with reason for refusal.
If they refuse (based on your limited info), that is basically a lawsuit waiting to happen. If I were NC, I would fire my attorney.
