WTF apparently missed a child support hearing

I just went out to get my mail today and found a notice that there's a warrant for my arrest! I'm only $2400 in arrears and about 3mnths ago I setup a payment plan and was meeting it every month to get caught up on this (with a divorce there were months where I hadn't paid anything since support wasn't setup yet).

Anyway I had everything in my budget setup and have been putting all of my EXTRA funds towards paying off other things when today I get that notice that I missed a hearing on the 10th and they issued an arrest warrant for me! I never received a notice of this hearing so of course I didn't go!

This seriously sucks, time to raid my reserves! I have like $1300 sitting in front of me (cash) but looking over my bills I won't have anything extra till at least friday...

So with a warrant out for me do I bother going down there to even try to pay what I have ($1300) or should I just keep my ass locked in the house for a week (when I should have the rest)

What pisses me off is I was paying my monthly support + extra and was working this total down regularly. If I'd have known about the hearing and gone I know there wouldn't have been any problems.

What state do you live in? What type of hearing was it? I don't see how they can issue an arrest warrant when you are making regular payments and making payments toward arrears.

I've had hearings where the mother didn't show for 3 hearings in a row and nothing was done to her. They just kept rescheduling.

This was a hearing that was specifically about the arrears so by me not showing they went straight to a warrant. with it.

I'm in Van Buren County Michigan. This is totally breaking my budget, I have like $1300 sitting in front of me that is the months gas for the car, food, fun that is combined with savings for a vacation so when I eat ramen noodles that extra cash ends up going towards a vacation. The rest of whats in the bank right now is already allocated to other bills. Almost all of my bills were due the past week so this is that part of the month where cash is at its tightest. NEXT friday I have like $3k coming in but the mortgage and some other things come out of that. I guess I could just take this $1300 down there on monday (first thing when they open) and if they lock me up I'd hopefully be able to get a hearing that day and explain things to the judge about how I've been making my payments regularly + extra towards arrears.

the problem is I still owe my lawyer for the divorce and new ones tend to want quite a bit fronted...

I was just in there a few days ago and made a payment even (before the warrant) I'll just bring in the cash($1300) and write the info they need on a piece of paper and hand it all over to them... If I see them do anything suspicious like leave the room or do anything like they're calling the cops I'll just get the hell out of there LMAO

If I can't get a hold of anybody decent over the phone after that I can sell some things around here and end up getting by this month so there's not much point in paying for a lawyer on top of all this when I'm sure I'll have the rest next friday.

I'm considering just not going anywhere till next friday or at least making sure I don't speed or do anything that could get me pulled over.

This shit just seriously pisses me off, thinking I had everything taken care of, paying all my bills on time, paying extra to crack down on various debts and then BOOM this shit comes

Things were working out absolutely fine but this hits simply because I missed a hearing date (10th) which I don't remember ever seeing anything for... Basically they had wanted me to be completely caught up by that hearing but just showing I had been paying a decent amount extra should have been enough to buy me a few more months.

I wasn't paying much without an order but yeah I paid some... gave some cash but mainly just bought her some new clothes and things like that simply because I don't ever want my kid to go without.

Personally the fact that you had to have a court order to support your kids puts you in the scum category for me. Then instead of working a 2nd or 3rd job and making the money that they NEED and deserve to live on your posting about it on GFY.... Things that make you go hummmmmmm

Everybody gets a court order for child support.... Like I said I was making sure my kid had everything she needed during those MONTHS before the court order was in place. You obviously don't have a clue how these things work. Even the payments I made by CHECK the court wouldn't "credit" me for so what I gave in the form of money, food, clothing wasn't even factored in when they gave me a bill for back child support. When you have BACK child support they give you a bill for what you owe each month and then an additional "arrears" number which is how much EXTRA you're supposed to be paying each month to work down on the total.

About the time I had the cash to completely pay off the back support the divorce settlement came in and she received basically all of my CASH, I kept my business, the house (which I didn't want but she didn't want the monthly bill, was on the market for 6mnths and couldn't sell to even break even) and also the car that had the most owed on it I also got stuck with.

She got basically all my cash + toys and had emptied most of the valuables out of the house when I wasn't living here. She ended up with tons of assets and I got stuck with all the bills and debt.

She never worked a day the entire time we were married. My lawyer advised me to just take the deal because he believed I'd get stuck paying alimony which in the long run going all the way through in court would have cost me so much more (then way more in lawyer fees)

I sure as hell can't be a deadbeat dad when she got all my money/valuables in the divorce and I had been paying the monthly amount but simply was struggling with getting caught up.

Seriously whats a guy supposed to do when basically all of his cash reserves and assets goes to the bitch and I got stuck with $3500/mnth in bills then have to make extra payments to my lawyer and child support/arrears on TOP of that

All while she drives an 07 vehicle that is PAID off and has money in the bank all while working PART TIME and still refusing to work full time simply because she doesn't need to (living off of my work)

She moved into a house that her parents own from her uncle dieing and pays $300/mnth for rent and basically has no bills at all...

I have 2 total, 1 with that bitch...

yeah, my new wife is a nurse so she makes a good amount of money. She gets paid for both jobs next friday. I should get a couple of my smaller ad checks next week sometime but my main one (google) won't be here till the end of the month.

I'm going to pickup some extra PHP dev work this weekend and run a few promos for an ES weekend sale and hopefully beef up my paypal funds enought to get this all paid off Tuesday.

You need to take some of that and get yourself a good (but cheap) attorney pronto. Explain the situation and then listen to what you are advised to do.

You will need a lawyer to arrange the payment schedule... I believe.

I wouldn't worry too much about it. What are they going to do? Put you in jail? I doubt it because that would make you unable to work and the kids wouldn't get anything under those circumstances!

It's very possible that the judge will sentence you to some suspended jail time under the condition that you comply with the court order in the future, including payments for arrears.

My advice is to turn yourself in, but make sure you have about $500 bucks in your pocket at the time. Offer to pay the $500 bucks towards what you owe and tell them that's all you have for now. Let them know you have more cash coming in soon and offer her another $500 from that, then request that the remaining balance be paid at 50 bucks a week until its paid in full. It will show that you are making an effort. Be sure to make them aware that you have living expenses that must be paid in order for you to survive! There is no way I would leave myself without anything to live on.


Also, even though it doesn't count towards what you owe, make sure you explain to them that you have provided financial support in the past, in the manner that you mentioned above. It will help to alleviate the dead-beat image in the eyes of the court.

You need 300 to get free. They just want to see an effort being made. then you can make up a plan from there. But do not turn your self in on friday or weekend.

yeah I'm thinking about going in when they open on monday with the $1300 on me and paying that and asking for a new hearing for a payment plan. If somebody just looks at my previous record of payments they'll easily see I've been trying my best.

Obviously I don't want to fork over the full $1300 since that would pinch me badly but I'll offer up like $500 first and see what that gets me...

Worth noting: the last bill I received only said arrears was ~$1700 so I believe they included THIS months payment in that $2700 which technically isn't due till the end of the month. I should be able to get by on Monday with only having to pay a chunk of the arrears amount.
