My brother got into a small fender bender. The accident might or might not be his fault. He was making a right turn when an opposing traffic started turning (left) and a girl managed to get into his lane, supposely cut him off and the right side of her rear bumper hit the left side of my brother's front bumper. So we have two young drivers, both blaming each other - no police report was filed. They have exchanged insurance and drivers license info.
I have a good friend who does fantastic body work, best I have seen, out of his house. I have offered to take care of the damage to her car just so we can forget this little incident. The bumper has a tiny little hole and scuff mark, can be repaired for close to nothing. Now the girl's dad took the car to some body shop and they quoted a new bumper, etc. for over $900 and the girl says she wants the new bumper which is not something I want to do. I was trying to resolve the problem on the down-low but now I am starting to feel taken advantage of. This is quite an unexpected turn of events. So my question is: do I tell this girl nicely to go away and yield to traffic next time or do I actually pay? |

I always try to settle out of court. Tell them they can take it or leave it, but if they go thru insurance they can be pretty sure their rates will go up, even if they are able to come up with an at fault driver.

hard to say if we didnt see the accident but i'm inclined to think its your brothers fault as he should have been yielding to her from the sounds of it..
regardless if you dont file a report and its minor damage then you should both be responsible for your own vehicles. tell her to get stuffed. If you wanna be nice about it , tell her you will buy her a bumper from a wrecker but you are not paying for labour or any cash period..

have her call her insurance they will pay the deductible and be on there way, if your brother had a red light before turning then he will be at fault and get a ticket if its reported with the cops, if not just call youri nsurance and let them take care of it for u

looks to be your brother's fault. he's making the right turn on a red. officially he's the one who has to yield.
but since no report was filed. it would end up in small claims court if they even decide to persue it that far.

Don't pay anything. Both parties could get in trouble for leaving the scene of an accident without notifying the police, so I doubt she will pursue legal action. Good luck to you and your brother.
