Well, the fact that they continually asked him to go across the street and would not state a reason is bullshit. They should have known a law that they could claim they were enforcing in asking that.

The fact that the reporter had a concealed .38 handgun without a license is PURE idiocy.

Within 1000 feet. Unless you have a concealed carry permit. Then you are only prohibited from taking IN to the school.

1. Yes they have a law about carrying a concealed weapon ON school grounds, however it will be up to the court to decide if that sidewalk IS school property.

2. When a police officer asks you to move, WTF is wrong with someone that they want to argue with a guy carrying a gun???

3. In Florida, the Officers have a law they use called. " Failure to obey a lawful command." In that law is a trespassing section.

That really is sick though, irregardless of the gun thing. The gun was never mentioned whatsoever. He simply saw a reporter and cameraman and tried to make him leave. Thats not lawful. Hope this gets updated.

Hey, it's not surprising that people are confused and think that police are able to create laws just by saying something. But it's false.

Do you know you dont ever have to take a breathalizer? Do you know if a police officer tries to imply that you'll get in trouble if you refuse them a search of your car or house, that it's just a ploy? Most people dont even know that simple stuff..

No you dont have to ever take a breathalizer, but in states like florida, when you sign for your DL, you sign that you WILL, and to refuse you are giving up your DL.

And yes you have the right to tell the officer that he can not search your car. Then, if you have been rude, or he thinks you are hiding stuff, he will arrest you for something, and when he inventories the vehicle, you will get charged with any thing that is in the vehicle that is illegal.

You fuck with a cop, and if he has half a brain, he will fuck you silly.

Sadly 99.9 % of the laws were made so that the officer could use them to protect and help others. But they are often misused.

You'd be surprise at how many people do actually know this.
But these things work better in a vacum and not always so well at 1:am when pulled over on a dark road in the middle of nowhere.

If I had exercised all my rights when I was stopped by cops then I would still be in jail for being a smart ass and not just letting them look at something for 30 seconds.

I think what he means is.... they had no basis for the initial arrest, no reason to search him and therefore invaded his privacy to find the gun. No warrant, no gun charges.

Unless the initial altercation can be justified (giving a real reason to cuff him for standing on a public sidewalk), they'll likely throw out any charges involving a gun that they should never have found.

Yeah I agree with all the "it may be your rights, but.." comments as well! And thats the thing with this video.. Even the police officer is SO well used to people just DOING it because he's a policeman and he said so, that when he was actually confronted with someone saying "But WHY?" he had no answer, lol.

I'm asking you to move.

Why? This is a public sidewalk.

Because I'm asking you to move to the other side of the road.

lol, oops! Someone needs a supervisor.. They need to be able to cite an ordinance or whatever the case may be, at least to cover the simplest question. Police are supposed to only enforce after all, not create or judge.. thats the other 2 branches of gov. jobs.

The school didn't want the news crew out front of their campus to do a story about how much violence is going on. Imagine that, a governmental entity not wanting bad press?

They reacted by sending the police to bully them away.

The officers acted outside of their authority and the law by ordering someone to move from a public location, simply because a governmental entity didn't want to be embarrassed by the press.

How many credentialed reporters go around trying to molest children or sell drugs to them with a film crew there to videotape them doing it?

One would "reasonably" believe that the news reporter was there to do a news story, not to attack children.

From what I could see (disclaimer: based solely on the video. The cops were there before the camera crew was, so there had to be something going on), the cop had legitimate concern about the crowds that would form on this public sidewalk if the reporter was allowed to do his report from where he was trying to do it.

Sounds like the reporter fucked up then since he did not have legitimate business in the school safety zone or any other authorization, license, or invitation to enter or remain in the school safety zone.

But a news reporter who has a gun to protect himself because of death threats from his last story probably has a reputation for doing stories that are harassing. Just a thought, I dont' know. I think the biggest travesty in that video is a missile in a schoolyard and a cop so fucking fat & out of shape that he is worthless as a public protector but probably makes twice more than the teachers in that "violent school".
