I think what he means is.... they had no basis for the initial arrest, no reason to search him and therefore invaded his privacy to find the gun. No warrant, no gun charges.
Unless the initial altercation can be justified (giving a real reason to cuff him for standing on a public sidewalk), they'll likely throw out any charges involving a gun that they should never have found.
