no 2257 compliance on it - isn't that part of your check through when somebody submits a site to you?

Joe that site is filled with stolen content - they don't have any age ID documentation for anything on that site.

didn't the owner of CCBILL not long ago make a thread on here with his idea how to combat content theft? I think a nice start might include NOT PROCESSING credit cards for them

I'm not defending these stealing tube sites, but as far as I remember, CCBill's policy is that they'll pull billing as soon as they receive multiple DMCA notices for a specific site. So, they'll react quick, but aren't proactive when it comes to copyright violations since it's very complicated to check ownership of the content and possible deals with those distributing it.

As soon as content owners act, they'll shut down billing...it's not a perfect solution, but they are far from supporting these kind of sites willingly.

Etology and AFF probably give a fuck, but I'm sure PussyCash and VideosZ will shut down their accounts as well if the content owners contact them.

no clue, i never saw one but i don't read all threads.

CCBILL may not as policy make their processing clients prove copyright ownership but in this case, CCBILL is very familiar with this industry and the nature of that site should be readily apparent to anybody there.

There is the other thread. Not sure what was resolved out of it but the thread starter sure got reamed.

For the record, I'm against theft 100%, but I am not sure what is going on with RedTube.

Have you looked inside their members area?

I can only speculate what one would find inside after joining. My guess is it's all bought DVD content, maybe some exclusive like they say, basically another DVD content feed plugin site.

So essentially their business model is to appear and operate like any other tubesite on the outside, but also have a twist, as bait in the customers and kind of trick them into thinking if they join they will be able to DOWNLOAD the same content but higher quality and faster inside.

Sort of like a bait and switch member site using a tubsite as a tour.

Actually maybe some of the content on the outside probably is their own licensed clips mixed in with the others.

Just a guess providing that they are still operating with CCBill after all this time.

Probably not a bad idea. A fake tube site that is.

Sadly thiefs have more protection than legitimate sites. It only takes a few weeks and a handful of $$ to build a site full of stolen content and begin selling - where as the rest of us legitimate owners are climbing uphill all the way and watching some scumbag make dollars off of our hard work

Especially on the weekend.

CCBill client support is available 24/7 (excellent customer support everytime btw), so their business hours are on the weekend.

CCBILL has members area access to the site, I don't. I highly doubt what's in there is licensed DVD content but since I haven't been inside I don't know. CCBILL knows the industry, not hard to take a look inside and see if there are Bangbros, NastyDollars and other well known programs' movies in there. Even if that is the case they are using stolen content on the free side to draw people in. It's wrong.

Calling them out? I'm alerting them to one of their clients who is possibly stealing content from their other clients who do 1000 times the amount of business with CCBILL.

CCbill has made it clear a few times.

1. They are a large and busy company and can not check every site to make sure they have proper licensing.
2. They do a check for visa approval when they set it up, occassionally they do spot checks but they have tens of thousands of sites to go through.
3. They take quick action when they recieve a DMCA from any content copyright holder. By having them show proof or remove all content listed.
4. If they recieve multiple DMCA's showing ongoing copyright infringment they will pull billing of said site.

So if a site is legal when it goes up they can swap shit around after they get visa approval and then unfortunatly it is in others hands unless they get caught in a red light violation (i.e. random spot check)

Webmasters need to alert others when they find such stolen content. Then content copyright holders need to spend the whole 3 minutes to fill out a proper DMCA and send it to site owner, CCbill, and hosting company. End of story. (however many copyright holders are to damn lazy to do it, well ussually the mid range to small companies are).

I agree. CCBill is a respectable company but they are very large. And in simple terms, they aren't always sure who's content belongs to whom. And it's not like it's difficult to change something or add something once it's been approved by CCBill.

The DMCA provides service providers a safe harbor from liability IF they act expeditiously when notified of infringement (A DMCA letter).

Failure to act when properly notifed exposes a company like CCBill to the same liability as the direct infringer.

Now, here is the problem:

CCBill processes for tens of thousands of sites, some of which I am certain deal in stolen content.

If CCBill were to cease processing on sites that they THINK, or BELIEVE are dealing in stolen content WITHOUT being notified by the rights holder, they would then assume the liability for ALL sites that they process for.

So in otherwords, site A, B, and C are all dealing in stolen content. CCBill, acting on a hunch, or a belief, cancels processing for sites A and B (without ever receiving a DMCA notice from the rights holder of the content).

They miss site C, also dealing in stolen content, and continue processing.

They have now assumed the liability for the infringing activity of site C.

The argument would be made, hey..you nixed A and B, but you continued to process for C. You believed that A and B were dealing in stolen content, well you should have believed site C was also.

Pay up.

That is why the DMCA notice was provided for in the DMCA. That is why companies like CCBill, eBay, etc CANNOT act in advance without proper notification, but MUST and do act upon proper notification.

It is all about liability.

Hope that clears things up.

sorry Jeff that doesn't wash - unbeknownst to me there was a previous thread here on GFY about this site and CCBILL was aware of it. I joined the site last night and here is some of what I found in it. CCBILL knows most of these sites very well, they process for most if not all of them and these girls are eminently famous in our industry - Raven Riley, Alison Angel, Kate from KatesPlayground, Melissa Midwest, NextDoorNikki, Dream/TeenKelly etc - it should not take a DMCA for them to know what is going on with this site - all it would have taken is for them to hit up Chris from FTV, Melissa, Spunky and ask 'We noticed your content in this site, we thought you should know as our valued clients -let us know if this site has been given permission to use the content, if not, send us a DMCA and we'll pull their processing, thanks'.

Interesting nobody from ccbill has even dared to post on this thread. It's been up for a few days. They no doubt have seen it.

I'm getting the feeling that Stealing content is ok. You'll not only get away with it but you can charge and get paid for it as well.

ccbill can't shut down a site just because a bunch of webmasters who don't own the content says it's stolen. that would leave a lot of leeway for webmasters to fuck with each other.

considering that gfy isn't on hahahahahahahahahahahaha, perhaps contacting the content owners would be the smartest thing to do. there are sites out there with videos with watermarks from other sites that have them legitimately, so ccbill needs to hear from the owners of the stolen content.

There's beast**** on this site too, just search for cat and you'll see it. I can't believe ccbill has anything to do with this site.

with all due respect, i think this post i had made in the previous thread would apply here, as you are referring to the same website

In any case, I understand this is hot topic and rightfully so. If/when we receive dmca notices that indicate one of our clients is using content they do not have a right to use, that client will not be processing with us any longer. Now I understand that the immediate response to my post by some will be ?well, you guys should just know when a site is using other peoples content and not accept it.? but the reality is that the staff in CCBill policy review do not have a way of knowing for certain whether a site is using content that they are not allowed to use and by law we have to abide by the DMCA

It is very simple process to send us DMCA notices, you don?t need an attorney and it only takes a few moments (see below) and if/when contacted, we will hold your hand through this very quick process. ([email protected], icq 45471840).

If your content is on somebody elses site without your permission, we want to know about it as much as you do

Looks like they are hosted with http://www.hahahahahaha.com which is a US based host unless I'm mistaken.

It's against hahahahahaha.com's TOS to have beast porn on your site...

Weird I can't type in their host name, anyway just look up their domain here and you can see it. http://www.whois.sc/
