FBI: Three Inspections to Occur Next Week

FBI: Three Inspections to Occur Next Week
Websites Are "The Next Wave"
By David Sullivan

Posted: 12:49 PM PST Sep 13, 2007

WASHINGTON - Federal Bureau of Investigation agents met with representatives of the adult entertainment industry today at FBI headquarters to address issues related to the federal 2257 record-keeping law.

The purpose of the hour-long meeting was to update the adult industry on the inspections conducted thus far, to listen to any adult industry concerns regarding the inspections, and to solicit recommendations from the industry on how to improve the 2257 inspection process.

While I read this, Chris or anyone can you please let me know who "our" or the adult industries representatives are?

PS: how did they become that, who elected them, is it a dictatorship/monarchy etc, anything at all?

Nevermind apparently here they are:
Adult industry attendees included attorneys Paul Cambria (representing LFP), Jeffrey Douglas (representing Red Light District and Smash Pictures) and Greg Piccionelli (representing Digital Playground), Red Light's Larry Schwarz, LFP's Sean Berrios, Julie Russell of Wicked Pictures, Gayle Ertz from Vivid Entertainment Group, Chris Haberski from KeepSafe, AVN's Mark Kernes, Tom Hymes of XBiz, and Lawrence Iyoho, Jr. of The Score Group.

Lots of video people to be honest, how did they get invites?

I didn't say that anyone could represent me at FBI Headquarters. I'm going to file a grievance with the FBI saying that I represent myself and that I don't appreciate anyone else representing me or pretending to represent me. This is bullshit. I don't know any of those people in the article. They didn't call me and say hey, can we represent you. They just took it upon themselves to blanket me in with the rest of the industry. Fuck them.

Thanks for the info.

What a waste of time and resources going after folks who are the most likely to have the 2257 records in the first place. Meanwhile I can barely read my "true" email as I sift and sort through hundreds of illegal spamming messages requesting verifcation of my U.S. bank accounts.

It's nice to see that they're willing to work with us to make this easier for everyone.

Remember the FBI has no say in what the law is or what the regulations are, they just have to conduct the inspections, whether they want to or not.

Nice to see the lines of communication are open and that they're not trying to play a game of "gotcha"

I already know the FBI never wanted to even have to assign resources to this and they have to follow orders. So it is no surprise they are working with us to make it as easy as possible for them and us. I seem to recall they jokingly said we will have to start the porn investigations in our own offices.

I however am more concerned with the representive stuff.

Thanks Chris, I agree the sampling of representatives doesnt really represent most of us. Most are Mom/Pop's and our concerns are different than big video companies.I wish they would let the third party, I would gladly pay for someone to deal with all the bullshit. As far as an government approved form that could be very very painful.

"However, Joyner said, five companies had engaged in “willful violations” of the law. According to Joyner, those companies have been subjected to re-inspection and remain in violation. Joyner confirmed that the inspection records in these cases had been forwarded to the Justice Department - however, he did not specify the exact nature of the violations."
So there we go... I think this right here will show us where this whole thing is going. We will see if they intend to prosecute people just for record keeping violations or an actual crimes involved with underage models.

Then there is this..

Quote:
"Joyner also said that three companies are scheduled for 2257 inspections next week - and that he understood that one or more of them was known to have some violations."
What are the violations? Underage models or record keeping?

The violation could be not having proper name and address on the 2257 page.I would say probably 80% probably have that violation.

I would say it is accurate to the tune of maybe 2 or 3 TGP's being compliant...

But when they say secondary, I think they actually mean subscription porn sites... Like Bangbros, Nasty Dollars shit... People who buy content from the producer and become a secondary producer when they put it up on their websites.

Otherwise their DB would be pointless. A handful of agents policing a DB with 300,000 webmasters in it. You would hit the lottery first...

And what happens when they pick theHun? They get on a plane? Not!

Exactly.

And does anyone really think the DOJ is going to take pornographers to court on a filing or wrongly labeled website DVD box?

The elections are coming up and the Republicans are shitting themselves already. Once it gets out the millions being spent to nail a pornographer for having a badly kept records they will lose even more voters.

Really? I am thinking nothing will get more votes than going after pornographers... Remember that Republicans are mostly white Christian conservatives...

They also fuck their male interns just as much or more than the Democrats but who is counting?

Generally, vigilence gets representation, apathy gets denial.

So, if you want a seat at the table, be out there doing, don't be apathetic.

Is that a fact?

Regardless, a TGP and blog will be checked for the first time at some point. Anyone posting explicit thumbs or blog content (including RSS feeds) is playing Russian Roulette at this point.

These webmasters, no matter how hard they try, will never obtain all of the ID's for the explicit content they are using. It's real easy to assume that your sponsors will hand over their ID's in your time of need, but don't count on the needed 100% success rate.

This whole fucking situation bothers me a lot. If "we" are being represented, how come we were not aware of this meeting? Why are we left in the dark beforehand. Are our "representatives" securing their safety from 2257 in these meetings while we are left to deal with this shit? 3 inspections this week, is that supposed to be taken as a threa or a warningt? While I am ratning, I just cannot fathom how idiotic and dense law makers can be when it comes to secondary producers. We do not create the content so why are we being targetted? They should go straight to the source. Simple as that or create a central database.

Seriously, why doesn't the FBI discuss this in a thead on GFY or possibly a different website which can be created to simply discuss tis situation and get the entire industry's opnion on solutions. Why the behind closed door meetings behind our backs. I guess our "comment period" didn't mean shit.

Yeah and after that the Canadian Mounties are gonna come inspect someone's records in New York

The DOJ can't enforce American laws on non U.S. citizens, there will never be an overseas inspection.
It would be like a Mexican police officer pulling you over for speeding on the 405.

Yes that could be, but that's the question. Are they going to try to convict people on paper work violations, or are they going to actually try and combat CP.

IMHO I think this will turn into more of an assault on the industry via "records violations" rather than a "real" attempt to do what the law was intended to do.

So far all of the inspections that I have heard about, were on legit businesses with nothing that's really questionable. Why aren't they going after those "child modeling" sites, if they actually want to protect kids.

Remember, they didn't get Capone for his actual crimes.. They got him on tax evasion. One could easily look at this law, and see how it can very easily be used to go after people that make their list.

Just like obscenity cases, no real crime, but it's a way to go after guys they don't like. Being the govt doesn't have a good track record winning obscenity cases, well my bet is on them misusing the intent of 2257 records as a way to bust who they want.

I also think this is a way for the govt, to try and down size adult and push out the little guys. I'm sure they would rather deal with a handful of big companies rather than the thousands of little ones that are out there.

One sure way to push out the little guys, is by regulating them out of business.

I think no one is going to get arrested for paperwork. It seems they have been using it as the cherry on top of the obscenity sundae. It would be very hard to get a jury to put someone away for 5 yrs because they werent in their office or they didnt cross reference to the 100th degree if the model is 29.

Well I just wonder with the law is on the books. Can local police dept's do their own invesigations? Is this a FBI only deal, or can local police dept's or DA's take it on their own to do records checks?

Seems this kinda stuff could easily be abused in more consertive areas if the local DA's and cops can go do their own thing.
