Hosting / Site Locale Legalities
I am launching a site for escorts. Escorts will upload their own photos. I will not be moderating the photos they upload.
Is it okay to host this in the US? or should it be hosted in the Netherlands or some other country? Is it okay for a US corporation or LLC to own this or should it be owned by an overseas entity? Are there any other things I should be concerned with? Thanks |

Already, with US hosting, you will be in default re 2257 ( these photos, not monitored, can, could and will contain sexual situation ).
In Canada, we do not have the 2257 laws. You should be able tough to prove, if necessary, that the person is 18+. Also, ESCORT services are a legit business. example: http://www.escorts69.ca/index1.htm

Do you know of a reliable (but inexpensive) company in Canada for dedicated servers? Also, do you know what is involved in starting a Canadian business (i.e.: costs, URL's for government sites, etc.)? Thanks for your help. |

You do not need a canadian corp to operate a website in Canada.
A corp costs about 450.00 ( numbered, such as 164897485 Canada Inc. ) To have a .ca domain, you do need to be a canadian resident.

Where you host may be irrelevant. Where you are incorporated may be irrelevant. My understanding of 2257, and UIGEA, and other related internet law is that if you do business with US citizens, you are deemed to be doing business in the US, and US law applies.
Consult a lawyer to know for sure.
