While we are not attorneys and do not give legal advice, it is our own understanding that while nothing in the new legislation specifically prevents the use of Hosted Galleries, the record keeping requirements may make them a thing of the past.

The proposed legislation appears to have three requirements that may make the use of hosted galleries logistically infeasible.

It seems the spirit of the legislation requires ALL webmasters to keep model releases and IDs on ALL models used in the images displayed on their sites. It does not make any exception for those using hosted galleries.
Each webmaster must be able to match the documents to each image in the hosted galleries.
The proposal for the new legislation also states, "Web pages appear to have an average life of only 100 days, and Web addresses disappear and change to such an extent that a permanent record of the depiction and its temporary locations (URL) are required." Thus every time the location of the content on a hosted gallery changes, the webmaster will need to update their 2257 records to accurately record the date and location of each image on every page of the hosted gallery.

When did 2257 ever require you to keep records for things outside of your own website? Do they even understand the term hosted gallery?

On the contrary. Hosted galleries will be more prominent as many programs will not give affiliates the 2257 doc to use on their own galleries using the sponsors' content.

Ounique is responsible for keeping track of every domain with its pics on it..

So..

If a person is uploading their content... that may be in the header of a gallery or something..
To a hosted gallery...

Ounique has NO way of knowing where its going or what the URL is..

It really makes things a crapshoot..

So that's what they're getting at..

I'm actually having to pull alot of my blog content.. because every category and archives is a NEW URL for the pics..

Lotsa little nitpicking things in the new 4472 that's fucking alot of us...

Did a bunch of retarded monkeys write that? Most sponsors with hosted galleries have 2257 info on them NOW. This new law doesn't change that. So why would sponsors drop them? If anything they'd drop giving out free content as that WOULD in fact require them to hand out 2257 docs.

i thought the same thing... that seems like what will happen... and in this case of hosted galleries being more prominent....
