Just curious and too lazy to check google right now so here we go... If i own a domain name, do i also own all rights on the name of the domain then?

I mean you have a domain called: sex.com, do you also own the name sex as a brand then? Or do i have to sign another pair of papers for this? I think i dont own the name as a brand then but hope someone knows it better then me. Sorry for my english iam just stoned as fuck

copyrighting is a legal issue. just because you registered the doamin does not mean you have a copyright on said name. Also, be aware that a copyright is different than a trademark.

I am certain he meant to say trademark and not copyright.

And yes, trademark and copyright law are both international.

You trademark a domain and can't trademark dirty words or common phrases and simple/common words. Many trademarks have to include the .com - such as sex.com. Since sex is a common word, they must add the .com to get the trademark.

It's something like this - It has been awhile since I was told how it exactly worked.

You would trademark a domain.

Copyright is for lengthy/ involved creative works such as books, art, software, music, etc..

Is US trademark law international or do we have different trademark registers? Like if I wanted a trademark in Mexico would I have to register it there and every other country as well? This is probably not the place for legal advice. It's just a casual question.

Of course you can trademark a common name - take for example Apple. There are around 12 different valid trademarks for Apple. Each one from a different company. If I wanted to start a company called Apple, Inc. selling peanuts to pigmy elephants, I could register Apple as a trademark and there is nothing any of the Apple's could do.

I went thru something like this a few months ago, so here is my

First, you dont "own" the domain name, you are leasing it on an annual basis.

Second, just because you have the domain, does not mean that you automatically own the "name", such as sex.com to sex

Third, just because you own the company name does not allow you to copywrite and take the domain name if it belongs to someone else. Such as if you have start the company "Larry's Applicances" tomorrow, but someone has the domain registered prior to that, its a tough fight. However, if you have the copy write or trademark on the "name" and some reg's a domain after that point, then you can get it back based upon some trademark/copywrite issues concering your name.

Again, im not 100% on this, but was in a similar situation a few months when someone tried to say that i was infringing on copy write because of a domain name i had which had their name in it.

Yes it is, and it's a ® trademark to boot.
The last time I checked (about 2 weeks ago), there were around 11 or so companies that had pending and approved trademarks for the word Apple.

this might have been said up above, but i dont think you can copywrite anything that is a descriptive word or phrase. it was a long time ago when i heard/read about this, so my 2cents may actually be worthless

Again, it is TRADEMARK, not copyright, and you are correct.

The reason Apple is allowed to trademark Apple is because they AREN'T selling Apples.

Trademarks that are descriptive of the activity taking place are not allowed. If they get through, they are easily challenged.

Some yahoo in canada tried to sue us for using the term "adult turnkey" which he had successfully registered. We filed an action with the trademark office and challenged it. Trademark gone.

If they are selling hats, they wont have a trademark for hat. It would never be allowed.

He is an attorney who specializes in just this.

Total cost for a simple trademark is $675 I believe. That includes his fee and the filing fee.
