Again, it is TRADEMARK, not copyright, and you are correct.
The reason Apple is allowed to trademark Apple is because they AREN'T selling Apples.
Trademarks that are descriptive of the activity taking place are not allowed. If they get through, they are easily challenged.
Some yahoo in canada tried to sue us for using the term "adult turnkey" which he had successfully registered. We filed an action with the trademark office and challenged it. Trademark gone.
