11. What is the dotzCD domain policy concerning trademarks and registration of names in the .CD Top Level Domain?
dotzCD registers domain names on a "first come, first served" basis. By registering a domain name, dotzCD does not determine the legality of the domain name registration, or otherwise evaluate whether that registration or use may infringe upon the rights of a third party. dotzCD neither acts as arbiter nor provides resolution of disputes between registrants and third party complainants arising out of the registration or use of a domain name. This dotzCD Domain Name Policy ("Policy") does not confer any rights, procedural or substantive, upon third party complainants. The entity applying for a domain name ("registrant") is solely responsible for selecting its own domain name ("domain name") and maintaining for the continued accuracy of the registration record. The registrant, by completing and submitting the dotzCD Domain Registration Agreement ("Registration Agreement"), represents that the statements in its application are true and that the registration of the selected domain name, to the best of the registrant's knowledge, does not interfere with or infringe upon the rights of any third party. The registrant also represents that the domain name is not being registered for any unlawful purpose. From more information on the terms of registering a .CD top level domain Click Here. |

Dude maybe try to learn some english before you are making a fool of yourself.
Russia is poor so get over it and get a job instead of finding all amazingly dumb ways to make a dime. |

Ok you can't sue anyone in Russia even if you do, you won't get anything done real fast. Point taken. I bet that when thehun's lawyers get in touch with the Registrar monday morning, Alexandr will lose his domain name.
Don't anyone go PayPal'ing your cash over to Alexandr just yet. 'The registrant, by completing and submitting the dotzCD Domain Registration Agreement ("Registration Agreement"), represents that the statements in its application are true and that the registration of the selected domain name, to the best of the registrant's knowledge, does not interfere with or infringe upon the rights of any third party. ' Oh and Alexandr, if I'm not mistaken, the minute you sell that domain, it's considered exploiting for commercial purposes, unless you transfer it over the the holder of the copyright/trademark. Playing by the rules will normally gain you friends and in the long run, make you money. That's my opinion. |

Foonic,
Even if US trademark law doesn't reach you in Russia... something I doubt given the *many* treaties currently existing between our countries... there is still a big, huge reason why selling this domain is silly: The person who buys the domain will have to deal with the Hun. You may be in a third-world country with weird laws, but most of us are not... Ian X.

Has thehun gotten his trademark on that name yet ?? I don't see it at uspto.gov only the applications that are not yet completed yet
http://tarr.uspto.gov/servlet/tarr?r...entry=76342867 Current Status: A non-final action has been mailed. This is a letter from the examining attorney requesting additional information and/or making an initial refusal. However, no final determination as to the registrability of the mark has been made. Umm maybe i'm totally ignorant but what's the point of having anything other than a .com suffix if person who owns a .com can claim the rights to the same domain with any other suffix?

Not true jas -
You have to have a trademark to the name in order to do that, and sometimes, depending on how your trademark is written you might not get it, if the other name does not conflict with your trademark. hey FOONTIC here is another one you should pick up, it just came open today www.howardsternspenis.com Tim ![]() |

Hi dear friends
Words like "book" "school" "dictionarry" etc etc could be a trademark, but can NEVER be copyrighted in any law. "thehun" is not a trademark. its a "compilation" of 2 normal words. so there is no reason to institute proceedings. ![]() |

Somebody's gotta play Devil's advocate, so I guess I'll do it. No person can or will own the rights to the words 'thehun' I don't think. The guy that owns The Hun tgp can copyright/trademark 'thehun' but it will be a narrow definition that will cover exactly what he does. I can open a car dealership called "The Hun" and there is nothing he can do about it.
Not taking sides, and obviously this guy selling this name seems like a doofus, but any business person with an ounce of sense should know that you don't have to turn a domain name over because someone else claims it infringes their mark. You use the domain in a non-competing industry and seek a legal opinion. Of course this is all my opinion based on my own research, so seek your own legal counsel if anyone ever tries to demand one of your domains. Any attorneys in the house want to chime in? |

Too funny Soul_Rebel... he bought it too ;-)
Quote:
Listen Alexandr... I have a team of attorney's one of which is bound to have the right contacts in Russia to sue you. Cybersquatting is internationally taken care off. You personally offered me to sell the domain. Haha! 100% cybersquatting. Do you know the fines for cybersquatting? Do you have 100,000 USD to cover those fines? You're not using the domain indeed, but your mistake was to offer it to me for a price. This is too funny. I'll give you ONE chance to transfer the domain over to me for free. If you do not take this chance I'd much rather spend 25K on a Russian lawyer to get your entire property auctioned 'cause you don't have the 100K which you will be fined than pay you 10 cents for this domain. I might even offer the possiblity to get your phonenumber removed from my page for 10K... ;-)... what a jerk. haha! |

Yep Hun I'd say he fucked up pretty badly by offering to sell it to you. His fate is pretty well sealed now.
I'm curious if you've run into anyone yet who has put a 'thehun' domain name to a legitimate non-competing use? Probably not because like you said, most anyone that grabs one of those domains is looking to cash in on your name. But in theory it is possible I suppose. Anyways it looks like you'll make short work of that idiot. Nice job. I would be interested to hear more about this $100k USD fine for cybersquatting. Can you provide some info on that? Never heard of such a thing and certainly never heard of anyone paying $100k for cybersquatting. Any news or legal links to that? Thanks. |

I guess they don't teach Russians what sarcasm is in school.
Why the hell does this guy still think he's in the clear? He's got 11 posts, he's Russian, and he's got a domain that he just shouldn't have. More importantly, he's Russian! Russians have a bad track record, and it gets even worse here on GFY. They don't seem to understand 'international laws'

Congress is going after the cybersquatters, taking steps to end the unauthorized use of trademark names on the Internet. Just before leaving town for a monthlong August recess, Senate lawmakers unexpectedly dropped a hammer on cybersquatters by passing a bill Aug. 5 in a quick voice vote to enforce trademarks in cyberspace. The Anticybersquatting Consumer Protection Act of 1999 (S. 1255), establishes civil penalties of up to $100,000 for cybersquatting. The fines have the potential to grow three times that under the legislation. .... nice one. ![]() |

just reffer in your site that these are the personal phone numbers of Anna Kournikova I'm getting pissed when I see scammers like FOONTIC doing the unbelievable things. They give the impressions that Russians are stupids as nation which is not true at all. They are VERY clever people and personally I have met few of them. There are Russians that do their work online like the rest of you. The ones that scam or use "unethical" ways of making money online (i'm not reffering to illegal) they do it and nobody ever learns who is behind it. These people are very smart and they make a lot of money. On the other hand, there are some idiots like FOONTIC that make the unbelievable things as I said, they are getting known very fast and of course they don't make any money. Smart scammers get recognision or even respect from few people. Stupid scammers get........nevermind |
