Would Zango be considered a "program.. which may cause.. inconvenience to any person"

If so, would this TOS entry mean an affiliate couldn't use Zango?

(viii) Any program, file, data stream or other material which contains viruses, worms, "Trojan horses" or any other destructive feature, regardless whether damage is intended or unintended, which may cause damage to any computer equipment, loss or corruption of data or programs or inconvenience to any person.

It may be an inconvenience.

Zango obviously does not "involve any program, file, data stream or other material which contains viruses, worms, "Trojan horses" or any other destructive feature or features that constitute a trespass or unlawfully intrude on privacy."*

Otherwise AFF would have to terminate themselves.

That's probably in a TOS somewhere right? I've seen plenty like that. A good way of saying they're against adware without coming out and actually admitting it in case someone was to send tons of joins to them and they didn't want to terminate them. Sponsors who use this terminology usually go on to say that they can terminate any affiliate at their discretion or something similar. You'd report them and the sponsor probably wouldn't do a thing about it because they're not breaking the TOS.

This verbiage to me doesn't mean using adware as an advetising media. It means actually having the download on their site in a deceiving way, like a driveby or "click here" or "play now" and the adware/spyware installs itself silently.

Sponsors that truly are against adware say so in very clear words that leaves no room for misunderstanding or confusion for the "hard of hearing". The rest of them I don't trust as far as I can throw. And those that say "you can send traffic any way you choose" should get thrown out the window without a second thought.
