Message for the people who joined me in the legal battle against Paymonde :

Following a telephone conversation with our attorney this morning, this is what was recommended (see transcript below) :

"Believe me when I tell you that I truly do understand the frustration that drives those who loose funds, to report it to the police?? however 2 things to remember, we do not want the person in jail, we do what the person to pay. We do not want your funds used to fight a criminal charge that is levied against the principals and trust me they will. If they believe they may go to jail they will surely use every penny at their disposal to hire the top attorneys. Our attitude is to always get the money first and then report them to the proper authorities!..."

In other words, we must recover the funds first then let justice take its course. Our collection agency is on the case. I will keep you all informed.

To those who proceeded on their own (but are still welcome to join us) :

Please DO NOT file criminal charges on these people right now! The police will prosecute them and seize the cash. They will fine paymonde and the money will disappear in the legal battle to cover legal fees. Please try a collection agency first, then go criminal once we have the money secured. Don't let your frustration blind you or you might end up with a big fat ZERO. Howard and the gang aren't going anywhere. It'll also give them a chance to pay up everybody NOT to risk going to jail for credit card and wire fraud.

One way or the other, you will NOT get your funds ( unless a trustee is appointed, then you could see a small part such as with Globill ).

Like Ibill, they will " move forward " ... So knowing that their asses are in criminal court, possibly in jail and certainly abused by bubba , doesn't sound that bad.
Better than bumping into them in a high class restaurant...

we recieved all our money, I think there is like $11.85 left is reserves but They sent my check last week so Im happy

we have gotten nothing, i waited and never even sent them an email asking what was wrong, I tried to refund some people their money and paymonde confirmed the refunds which never really were refunded. still no word from them about anything. I have someone in Canada working on it for me, nothing to do with the cops either.

Well we'll see about that but if I don't get my funds and need to stay at the head of this story until the end, I will make 100% sure they end up in jail or something else... I've always worked within the legal system and it does pay off if you are patient and don't loose hope. It also helps if you can pay the legal fees for as long as it takes...

Howard will not pay me for as long as he can because I'm pissing him off big time but he's just going to keep me on his back for more than he can manage.
They only owe me 9300 USD so I'm not doing it for the cash because I don't live off of this. I'm doing this because what they did ain't right and some people here will be needing some help. Some don't have a cent left to pay off a lawyer and try, hopefully, to get something back. they are currently concerne about payig their rent...

In any case, I will not let anybody down. I never have and won't start now.

On another note: I will be helping out Janet Conway of Merchant Risk, Recovery & Intelligence, Inc. to setup a conference relating to this and other similar issues at internext. How much total money is involved here. I might have someone I know who can deal with it. The funds outstanding would have to be rather large though.

I.E. he just seized and closed a Chrysler dealership here in Toronto so he doesn't deal with small matters.
