Why are we so sure "secondary producers" means affiliates?

I mean, logically speaking, the primary producer would be the shooter of the content, and if you purchased the content, (as in a non-exsclusive paysite or purchased content for your own promotion) which would be compliant as you get copies of all docs when you purchase -- then wouldn't "secondary producer" stop there?

Why do we assume "secondary producer" is an affiliate? If you're using the content from the "secondary producer" (affiliate program), doesn't that make you a distributor, or something along those lines and not accountable?

I believe it's because when you then use that content to build a new web page. They consider that as a new published work.

good point, but I think it's yet another "gray area" that the man can choose to enforce or not at will

I don't see why affiliates presenting content as belonging to a paysite is any different than a brick and mortar XXX movie theater.

Mutt, I haven't had much time to look into this, as I am very busy. While I agree it is a priority, I was under the impression that the industry was assuming secondary producers were affiliates (which, according to that link, still is pretty unclear).

Sapphic doesn't have anything to do with my personal research, and has their own legal counsel, which frankly, is not anything I am privy to unless I'm specifically told something.

Of course, after your comment, I did do a google search to find out why I would sound so stupid and stumbled on that link above, irregardless, the point of this thread was to debate something that I think everyone is not 100% clear on in the first place.





And FreeHugeMovies, when are you going to lose that hardon you have for me? I think it's funny that you never say a damn thing but are pretty swift to come in when someone else does. I know it's easier to jump on a bandwagon but personally I would prefer it if you just hit me up in ICQ so we could sort things out like adults. If this is about that conversation SEVERAL months ago about an issue I don't even give a shit about, I already explained my reasons to you and I'm not going to do it again.

You appeased my curiosity but took it WAY too personally. In my mind it's a non-issue and it should be for you as well.
