Did they change the provision that exempts those who have no reasonable control over the content displayed?

It depends - i heard that Google use server farms all over the world, so if they serve your session via a non-US server, then they are in the clear.

When are some of you going to finally understand that where your content is served DOESNT MEAN A DAMN THING. The only thing that matters is where you are physically controlling them from.

If you are in the US but your server in China, you are bound to US laws.

If you are in Russia but your server in Canada, you are bound to Russian laws.

And could it not be argued that you are physically controlling them from your foreign entity operation? Don't get me wrong - i haven't got a clue about the organisational structure of Google (they don't exactly wear it on their sleeve), but if they have a foreign entity in, let's say Russia, that directly controls their Russian operation, then therefore (by your logic) then are in the clear - correct?

If you put an RSS feed on your site that is constantly providing material that violates law you can't claim you have no control over it.

You are wrong.

Read the bill here http://www.govtrack.us/data/us/bills.text/109/h4472.pdf

Google, and all the other search engines would be classified as an Internet Information Retreival Tool and are thus not affected.

Thank you, I was looking for the legal language. It was killing me the way everyone in the thread was talking.

And where did you see that provision? Please quote it from the statute for the attorneys that missed it

It cracks me up that so many people spend more time worrying about what Google does than about what they're doing, as if a good defense will be to tell the judge that "other people are breaking the law too!"

Wouldn't RSS feeds be an "Internet Information Retreival Tool"?
