Using an RSS feed is not illegal, modifying, yes it is. I was referring to JUST using an RSS feed as is.

what determines fair use?

honestly, I don't see what the big fucking deal is. stripping links and replacing refcodes is fucked.

But being syndicated, benefits you if you know what you're doing.

If anyone wants to take my feed, please, go ahead just don't mod it and I won't have to send your host a DMCA

.. its about the final output, and the commercial value, that matters. If your work is not registered (like trademarks), has no real commercial value, no actual damage from the violation or the defendant has not gained from it.. then it would probably not be good enough for the court.

Court or not, its about respecting others work. RSS or whatever. Ask yourself "why you are doing it", not "do I get away with it".

I can't speak for anyone else, but I imagine if you left links and what not alone you would be fine. In a way, those links could be considered 'payment' for the use of the content.

First, let me say that I agree that syndicating, not providing a link back, and changing sponsor codes is totally fucked and I do not agree with it. Now, with that said, on to my post.


Dirty Dane, syndicating via RSS is neither legal or illegal at this point because its never been tried in court. All talk on this subject is purely academic at this point. The honest truth, who ever has the most money for lawyer fees will win this battle. Better start saving...
