.. its about the final output, and the commercial value, that matters. If your work is not registered (like trademarks), has no real commercial value, no actual damage from the violation
or the defendant has not gained from it.. then it would probably not be good enough for the court.
Court or not, its about respecting others work. RSS or whatever. Ask yourself "why you are doing it", not "do I get away with it".
