I just got back from the FSC meeting...

Among the topics discussed is Utah spam bill (should be called "scam" bill -- this really will not effect many here unless they mail), the Atlanta Court of Appeals CP ruling, dot xxx, the porn tax, political activism, and (of course) 2257 -- which is a long way from being over.

If anyone has any questions about what was said...post them here and I will tell you what I heard. I was there for the whole meeting and had a good chance to chat with the board members and layers before and after the even.

So, post you questyion if you are curious about anything.

Basicly, the law is being pushed through by a for profit company that will scrub email lists so that nobody is potentially emailing minors. To have your list scrubed it costs .5 cent per email. There's another interesting point. There is no garuntee that the scrubbed e-mails actually originate in Utah. Anyone can register for the database which the company offering the scrubbing (http://www.usnpam.com). Also, another interesting point is the case of shared e-mail addresses. Say a husband and a wife share an e-mail address. The husband OPTS IN to your e-mail list, however the wife puts that e-mail on the Utah spam lists. You would still be fined and penalized for that e-mail.

Oh, by the way, this scrubbing isnt a one time thing. The Utah law requires that your list be scrubbed ONCE PER MONTH.

Yep, I forgot to mention that .5 cents times your number or emails times once a month to comply.

Major scam. USNSpam will get rich quick if these laws pass.

Not only could you face criminal persecution...whoever got those emails would then have the oppertunity to sue you in civil court. And, believe me, they will.

This would totally wipe out revenue programs earn through member / ex-member mailers and after a while the affiliates can kiss the $35 PPS goodbye.

Moving offshore is more complicated than you think. Even if you have an associate overseas registering the company - good luck repatriating those funds to the US.
