Were the real problem is...if it passes in Utah...other states will quickly follow...so in a nightmare scenerio...you could be paying out a private company .5 cents per email times 50.

There's another interesting point. There is no garuntee that the scrubbed e-mails actually originate in Utah. Anyone can register for the database which the company offering the scrubbing (
http://www.usnpam.com). Also, another interesting point is the case of shared e-mail addresses. Say a husband and a wife share an e-mail address. The husband OPTS IN to your e-mail list, however the wife puts that e-mail on the Utah spam lists. You would still be fined and penalized for that e-mail.
Oh, by the way, this scrubbing isnt a one time thing. The Utah law requires that your list be scrubbed ONCE PER MONTH.
