Some people are so stupid it gets funny. Here's another. Maxwell Productions, run several sites, including one that caught my attention: thehunyellowpagetgp.com. Obviously this name infringes on a trademark, so I write the fellow about this:
Please stop serving the domain thehunyellowpagetgp.com for it?s infringing on a registered trademark. I am the owner of The Hun?s Yellow Pages at www.thehun.net I get the following reply: How so. hey would you like to buy the name.? Haha... Ok, you have to give the guy credit for his resourcefull ways to raise money. Anyway, my reply: No, I?d like it to be closed down. I own a trademark for that name. This e-mail is to give you a chance to close it before I start legal action... Now it gets better. Here's his reply: or what name thehun... the name of the site is not thehun the name of the site is thehunyellowpagetgp do you also have a trademark for that name as wee or do you think the ANY word containing the letters thehun is owned by you. And then another e-mail straight after that: how about thehungreychildrenoftheworld.com go away or purchase the domain. im asking a reasonable price. And this guy is trying to do business in the Adult Internet World (http://www.pornwebhost.com,http://stealth.wcivr.com)... This guy has 24 hours. I'll then send my attorney after him. He's from the US, phonenumber, address, everything is on file here. Funny this guy does not realise the hight of the penalties for a trademark violation. He suggested I'd pay him instead of spending more money on an attorney. Since this case is chrystal clear I don't really mind putting up the money, I know I'll get it back at his expense anyway. What a guy. Fun to see there's still people around that are this stupid. Pity I have to waste time on people like these though. Maybe I should set a presedence with this guy. Legal action will get him in a lot of problems. I think that's a very severe punishment for stupidity. But some people just won't listen... |

Maxwell is running a TOTAL scam. He's one of the guys that sells newbies bogus complete paysites, etc. I worked with a client 1 year ago that was this really nice lady who was basically screwed by them... and when she wanted to stop paying him monthly fees for his 'turnkey' he played games with giving us the Netsol access on her domain. bastard! I talked to him on the phone and he was a dirty motherfucker who was swearing and yelling at me, I think he even called me a fucking faggot or something like that. Brad

Maybe the Hun needs to have a page of people who attempted to register similar names and gave them up upon obtaining legal advise since it was a trademark violation. Might help as a reference for others trying to scam off the hard work of an established well know trademarked site.

When can the owner of a trademark stop others from using it?
Whether the owner of a trademark can stop others from using it depends on such factors as: whether the trademark is being used on competing goods or services (goods or services compete if the sale of one is likely to affect the sale of the other) whether consumers would likely be confused by the dual use of the trademark, and whether the trademark is being used in the same part of the country or is being used on related goods (goods that will likely be noticed by the same customers, even if they don't compete with each other). If someone is porporting to be the hun with their content i can understand using lawyers and whatnot but it seems llike people are progressively leaning towards opening up bigger cans of worms with domains infringing on trademarks and whatnot. I mean where does it end, you start suing people for registering 'thehunsucks' and 'theehun' etc? Like most classic dilemmas of this nature its too eazy for the line between whats arbitrarily acceptable or not to become blurred and eventually you have a bunch of webmasters squabbling amongst themselves over something that doesn't really effect their bottom line anyway in an industry that already has enough problems.
I find it weird too that whenever the guy from the thehun posts he never responds to anything else on the thread ![]() maybe he'll be my USA wife? |

chodadog that's EXACTLY what i'm saying, it begins with something seemingly legitimate but then once you set a precident where does it end?
eventually you have thehun suing someone for using 'thehun.us' or whatever, "TheHun" is a pretty common nicknick in chatrooms, game servers, etc, so now you have to start speculating and assuming this person 'stole' the concept of using the name 'thehun' for the internet domain name from you and pay your lawyers etc etc for something that isn't affecting you or your business in any tangible way in the first place. if youre not using content from the 'trademarked' site, it seems questionable whether it should really be an issue or not. In this case the person IS using the content, so being proactive can be understandable, but going on witch hunts for 'thehunt' dirivitives is pushing it. especially when it appears inspired by an overanxious desire to appease thehun anyway. ![]() |

thehun.us would be trademark violation. If you were to register cocacola.us, you can bet your ass coke would sue you.
It's normally fairly easy to tell. If someone had a website called thehuncars.com and it was for a used cars lot in nottingham, england. I dare say, that wouldn't be trademark violation. Or at least, i don't think it should be. Could one of the legal eagles here correct me if i'm wrong ![]() But this domain he's talking about. It's just.. completely obvious. |

I actually remember looking up at one point in time, the hun, and a few others when this argument happened with that other fucker who decided he didnt want a new domain from the hun.
I believe the hun has complete rights to THE HUN over the net, in advertising and marketing, and a few other things. If I recall, he doesn't have complete trademark rights to the name in relation to non-advertising and marketing. If thats right, couldn't anyone open up thehunismybestfriend.com as long as it was a site not involving The Hun, as we know him in this industry? Any actual legal gurus around? But... Im pretty sure I got the jist out of it. |

Is the trademark registration you're referring to a US trademark or is there some international trademark registrar I'm unaware of. The only completed registration for "The Hun" that I find in the US Database is registered by someone named Eric Rosidivito in Wyoming. I see several applied for trademarks that are done with you as the owner, but that is the only registered one. Is that guy your agent in the US or is trademark registration 2354474 someone else? |

chodadog, the problem is though, whether you win or lose the lawsuit is entirely irrelevant, when you're suing someone who is small time the legal fees are punishment enough, and they're probably just going to give up and give you what you want because you control the money, so you control the lawyers, so you may as well control the legal system at that point because you decide how many court cases and legal fees there will be regardless of their outcomes. These are the pressure tactics used by huge corporations and other nefarious organizations like scientology to silence things they don't appreciate everyday. I'm not saying THIS guy doesn't deserve it, afterall he is stealing the content, i'm just saying i think this is an area deserving of extreme caution.
