ISPs, Large Businesses, Netscaler SCAMS to meet numbers!

OK, I will make this as short as possible, but definately do not do business with these ASSHOLES!

This company is commiting Fraud to sell boxes and meet their numbers. They asked to to eval one of their units, never got past install, and then they basically said they would not take the boxes back and I needed to pay for them. Why? It appears to be so that they can meet their numbers. Here is part of an email from Shawn Nunley at Netscaler:

Regardless of whether they were used or not, you signed a PO. A PO is a contract to purchase, and has binding terms right on it that say you, the purchaser, will pay for the units. It is not a contingent purchase or an evaluation. It is not a demo. I think Anthony let himself believe you were buying the boxes based on only the little information you had. I think that was a mistake. However, our company would have every right to pursue collection on this matter as you did sign a contract.

If NetScaler wanted to be tight about it, they would make you pay for them. You have NO idea how much we need the revenue numbers right now, and debooking revenue gets attention at the highest level, making us all look like idiots. This has impact at many levels, including the poor sales guy who has to eat the commission that he has already been paid. I have lost some reputation capital on this, and that pisses me off. Nothing can be done about that now.

When I showed up at the Netscaler offices, I mentioned that our company had changed and we would probably not need them, but our upstream may be interested. I said I would test them out, and our upstream was interested to see the results.

Your guy Keith came out and we where not able to install the boxes. I thought the Netscaler was an inline device, but as it turned out, it was not. So in order to try out your product, we needed to by an 8 port Gig switch. Also, in order to deploy your switch, it changed our topology. The logs where going to be effected and we where concerned about the effects on our customers that may occur. So basically, we where still going to try out the box, but we where only going to do it on a few customers.

What happened from there is that we decided based on all the changes that would need to be made, it was not worth it for us to go forward with the testing. We told your guys, sent emails, and everyone was on schedule that we where returning the boxes to your company. We even got an RMA #.

I just received the boxes back today as they where refused by your company. Myles was told that your company is going to proceed with collection against us. Is this how your company wants to sell boxes? Dump them off as a demo, don't even install, and then stick us with a bill.

If you want the honest truth, the only reason I even considered trying the box is because you worked there. Now, this is turning into a headache for me. So basically, I do not want these boxes and I feel that the way your company handled this is real shitty. I am asking you to take care of this for me, instead of having me go back and forth with people at your company.

If you can not do anything for me, I will not take it personally out on you, but the only other option is to take this to courts.

Yeah, that looks better. I assume that it does not rat fuck your network like the Netscaler?

Most states that I ever knew of (from purchasing from businesses located in those states) have the 30 return laws. I used to buy alot from mail order cats since we lived so far from decent shopping and ran into things that I decided weren't what I thought they should be. So I returned them. Never had many probs doing it. Also sent back equipment from the my ex's machine shop now that I think about it.

I'd contact your state attorney generals office and find out what division they have that handles this sort of thing. Then tell netscaler you have filed a complaint and will follow up with a civil case to force them to accept return as well as compensation for all court costs and perhaps if the judge deems it acceptable - any damages you can get ahold of. Best scenrio for that would be to have 1 or 2 others treated this same way as witnesses for you AND present - no letters or affidavits,

I think I will hold off on any fancy packet shaping for a while. Things have been running sweet.
