Well, don't know if this has to do with Hegre contacting google or what, but my domain is back in Google. Only pages that were affected by the complaint were removed. I get the following message at the bottom of the page when I search for my domain:

Quote:

"In response to a complaint we received under the US Digital Millennium Copyright Act, we have removed 2 result(s) from this page. If you wish, you may read the DMCA complaint that caused the removal(s) at ChillingEffects.org."

has always been like this. no?
problem was that a lot of mainpages got deleted, that referenced to galleries, galleries were left alone, which kind of prooves that p10 wasn't in it to protect "his copyrights", just targetting sites that promoted competitors with the same models

The Advice Asshole 01-20-2006 06:17 AM

In response to a complaint we received under the US Digital Millennium Copyright Act, we have removed 3 result(s) from this page. If you wish, you may read the DMCA complaint that caused the removal(s) at ChillingEffects.org.

For my search, but the three pages are 1)My main page, 2) My main forum page, 3) My main WTF? Gallery page.

But, if you search like this "site:theadviceasshole.net marketa", the pages that were the reason for my site to be removed are coming up. >:(

I talked to Hegre about this. They made perfect 10 send 2 counter notifications to google (last one, one week ago). They also talked with Google's legal deparment but they are processing things slow (remember it also took them weeks after p10 inital letter to take the regretted actions).

Emotions are fine. But this will only be fixed with patience and using our heads. Crying on boards aint helping a bit. It's in google's hands now and no matter how frustrating it is for us, a bunch a of adult webmasters is probably not on top of their to-do list.

JOHNDX 01-24-2006 04:37 PM

A few weeks ago when all this started. I did all the normal things. Contacted Hegre, Norm, Google, etc..

Then I remembered a regular visitor from my site. A copyright attorney. I submitted to him the responses from Norm, Hegre (never heard back from Google) and he advised that I file the counter notice, since I had nothing to hide. I did that last Monday. It's been 7 working days.

No word yet and my main pages are still not showing up on Google. My attorney 'friend' tells me legally, Google has 14 days to either respond or re-instate my site(s).

At any rate, if the 14 days come and go, like I think they will, then I have exhausted all my capabilities and will gladly join this lawsuit (if you guys choose to follow through with it)

Let me know.

Just my two cents

On The + Side

On the plus side, MET-ART has made the FHM UK list of the 50 best websites in the World...I believe only 3 adult sites made the list.
Title: 50 ADDICTIVE WEBSITES - 50 KILLER WEBSITES: Discover Exactly Why The Internet Was Invented.

We will add the cover to the free hosted galleries in a few hours. It should help affiliates sales. We're already feeling the effect, sales are VERY good.

No MET-ART, as many affiliates, lost revenues because of someone's not so innocent mistake(s), and while that someone was making these mistakes, on another magazine, namely FHM, something good was happening, and since the day the magazine came out, affiliates sold 10% more, which probably makes up for the mistakes made by others (Again, not us). What's best, it did not end up screwing affiliates, but It's just good news, and it's showing two different results on a similar topic. I'm still livid at our losses, and most of all, the affiliates writing us, thinking that we made the same mistakes, or were involved in this crap, and probably some of them, dumped us because someone (God knows who!?!), implied that we were sold outs too, although WERE DID NOT...

Someone else's failures had an effect on us. Not only we did not make the same mistake, but we're offering affiliates, and 90% of them are common affiliates, a chance of making back some losses.

At least let us do this. It's giving back some lost money to EVERYONE, not just us.

I think It's less out of context than you think.

??? Are you sure you want to address us, and not the sites that are actually involved? MET is a involved as any other affiliate that got his domains banned.
We've all been damaged by someone else's plans / decisions / moves.
There's really nothing we can do about it.
We did not get involved with the P10 guy, others did.
I'm pretty sure that Google could care less about what everyone's motive was. All they care about is stay out of trouble, and they have every right to do so.

JOHNDX 02-01-2006 09:26 PM

Congrats on the FHM plug Met you guys deserve it.

As for the Perfect10 issue, there really isn't a whole lot we can do about it because I don't think any of us purchased the pics from the affiliates. I'm guessing they were all given to us. Therefore, we have no legal standing on the issue. It's up to the affiliate, perfect10 and Google.

Hopefully, the three of them are getting there heads together.

They managed to get themselves off the blacklist...

Zarathustra 02-01-2006 10:08 PM

its not good business practice for Hegre and Modelflats because now people will think twice before EVER promoting them again and blacklist them as sponsors since they don't care about their affilates by selling their content to p10 and getting the affiliates banned from google

Series 02-01-2006 10:08 PM

2 days and several emails later and not a 'boo' from Hegre... I'm starting to wonder if us affiliates were in fact given content that was exclusive to Perfect 10 :Oh crap

oyvind 02-02-2006 10:09 AM

In reference to Perfect10's DMCA notification to Google, we here at Hegre-Art.com would like to clear a few issues.

In December last year we licensed a few photo series to Perfect 10. Precautions were surely taken from our side, so among others, all affiliates of Hegre-Art.com were of course declared as legal users of our content in the contract. Nevertheless, Perfect10 makes the big mistake of including 105 of our affiliates in their DMCA notification to Google: http://www.chillingeffects.org/notice.cgi?sID=898. They even listed our own affiliate program domain as a copyright infringer : http://www.newnudecash.com/ . Google's reaction was to randomly block some of the sites listed, and therefor some of you have lost your sites main page listing at Google.

In the after shock of this happening, we have made Perfect10 send 2 counter notifications to Google admitting their mistake and asking them to reinstate all Hegre-Art affiliates. So far Google have not reacted, and as the secretive and closed company they are, they have just politely ignored our numerous attempts to solve this issue directly with them.

At this time we are working on getting a court order issued to Google to force them to immediately annul Perfect10's DMCA notice and reinstate the Hegre affiliates that has been blocked. When this has been done, we will evaluate the situation and consider suing Perfect10 for breech of contract and claim compensation for damage.

This is a very unfortunate situation and we can only apologize for the inconvenience and hope that it is being resolved asap. This is as frustrating and damaging for us as it is for you that have been touched by this incident.

We will keep you updated and ensure you that we are pursuing a solution will all our very best efforts.

Hegre-Art.com Staff.

and yes you should sue, so this doesn't keep happening: too many people lost money and have already lost too much time with this
the overall damages are probably HUGE
