OK...that seems to clarify some things. Apparently the Judge did not place any special conditions for bail.

When the prosecutor filed a charge/charges...the Judge by binding the defendant over for trial accepted that the prosecutor has a prima facia case of criminal wrong doing. Since the content of the website was accepted by the judge as being a prima facia case of criminality...it only stands to reason that is why the judge revoked the bail as the same prima facia case of criminality was being continued.

His attorney should have issued a strong warning about the dangers of continuing to operate the website...and maybe he did.

Yes and being a first amendment attorney I would imagine he told him to leave the site online. Wouldn't shutting the site down be spun as admitting the site was illegal by the prosecution?

Rule #1 - Do not live or operate an adult or similar business in an ultra conservative community.

Rule #2 - You are not safe from prosecution by having your servers outside the US. Its hard to believe so many still think they can get away with this. You can't.

Rule #3 - Never ever mock, disrespect or laugh at the power of Federal Prosecutors, the DOJ, State Attorneys or FBI Agents. They can and will fuck your life upside down even if they don't successfully nail your ass in a prosecution.

Rule #4 - The closer you operate to the edge of the law, the greater the probability you'll get sliced one day.

Rule #5 - If the heat comes down on you, don't count on much support from the industry, you're on your own.

A good attorney should have given a strong warning as to the risks of leaving the site up...as it would not be the attorneys ass going to jail for revocation of bail.

I have know possible way of knowing what the spin would have been or will be by either the prosecutor or the defense attorney at trial. But it is now apparent why bail was revoked.

She eventually had to agree to never run a site while living in Polk County and a few other things, but that was after a pretty extended back and forth battle.

It does NOT matter what you do personally. A lot of people don't want to push any boundaries themselves. That doesn't mean you shouldn't support the people that do it for you. A local government bringing obscenity charges should be scarier than the feds because they could easily find a small community that wants nothing to do with porn and bring every adult site based in the US up on obscenity charges one at a time.
