I'm just courious.. But why would you settle if you didn't break the law in the first place? TOS or not.. I know for a fact I have recieved spam from some of these companies in the last month. Looking to see if I can dig it up again..

The cost of settling is far less than the cost of defending yourself against the FTC. If you're not making that much money from mail, it may be a better choice.

I don't think I have seen any spams or emails from you guys :)

I do however look at my spam email, it's a great way to get marketing ideas.

It's easy for programs to claim "rogue affiliates" do the actual spamming.. What's to stop a program for simply sending mail supposedly from an affiliate? It doesn't take a genious to come up with such a scheme.

I guess nothing stops them, but it is simply bad business. A scheme like this cannot be very hard to spot and then what follows would be a mess bigger then what is currently going on.

That's simply not true. It'd appear as if it was just another affiliate, nothing more and nothing less. Makes you wonder if that's what some of them do. The "sorry, it was an affiliate of ours" excuse is old.

If it was "just an affilate" and they closed "every affilates" account that broke the spam laws they wouldn't be paying $650k fine.. They would be fighting it, much like TopBucks is doing..

Settlement means they admit they broke the law in some way. It would be much cheaper for them to fight it, unless they thought the FTC would win the fight...

Breaking the law isn't okay, and paying a $650k isn't a big deal for a lot of adult companies.. It is a big deal though when it's a fine for breaking the law.

I have always gotten along with most of the board nemesis, if you will. I just see past it most of the time. I get along with a lot more people that way.
