Can they go after FSC members retroactively later on? If I go back to using hardcore promo materials that I don't have docs for until the next hearing(then switch back to compliance, of course) can they come after me if there is no further injunction/TRO?

In other words, can they take a million screen shots of websites today and then go after FSC members based on that down the road??

I have to say that I disagree with that statement. Yeah, sure, some people are always going to throw money around to they can scoff at the laws but some people like myself, in this case, have worked YEARS to build a legitimate business based upon the existing statutes. Small in size compared to a lot of the businesses whose owners post here, but it's MY business and if it behooves me to spend a few dollars to KEEP my business because I don't think the gov't will EVER stop persecuting those of us in the adult industry, then so be it. I want to scream this out loud since some of you cannot read and understand. This only applies to the plaintiffs in the lawsuit including FSC members and all it does is buy time to get your records in order. Unless a permanent injunction is granted this is still law effective June 23 2005.

You are not wrong. Greg Piccionelli explained that lawyers do not have the time to decide whether or not your corporate structure was set up correctly, so he recommends that you join both as a corporation and as individuals, which include all officers of your corporation.

OK yall read that again specially the part about UNTIL the court rules on the injunction.

IF the injunction is granted it could be MANY years before it can be enforced.

I dont know enough to know if this could have been as a class action status and encompassed everyone or not but bottom line all that has happened as of today is that the FSC has bought 40 some odd days.

the news is hardly THAT Great

a ruling that in its current form 2257 is unconstitutional on just about every level would be much better.

That said I do want to give the FSC some credit for picking up the fight on this...I have been critical of them in the past, this time they are doing the right thing and deserve support.

FSC is performing a valuable service for the industry. Paying $300 or more is nothing compared to the thousands a single entity would pay in legal fees to fight something like this. It's power in numbers and it is everyone's responsibility to contribute to the FSC. Not only to protect yourself from unjust laws but to send a message to the goverment that we will not sit around and be trampled on like crooks. We are legitimate business owners and we have rights that MUST be respected by the government, regardless of their personal religious views.

KRosh is right, this law affects EVERYONE, not just U.S. webmasters. Foreign companies will see a short term increase in their revenues if the law is proved valid, due to many U.S. companies shutting their doors because their are unable to comply. But they will lose in the long run as they will see less revenue due to an overall shrinkage in the market.

Does it really matter if the FSC gets richer from this scenario? It can only benefit the industry as a whole since we will finally have a unified organization that will be able to boost lobbying efforts and further protect us from these type of shady laws. It's time for the industry to think in a more progressive manner rather than the "how quickly can I make X dollars and get the fuck out" attitude. This industry is still in it's infancy has much more room to grow, however, this will not happen if we do not battle the forces that try to suppress our right to choose our own lifestyles. The right wing is trying to force it's "morals and values" upon the rest of the country and they are working VERY hard at it. We need to work equally hard to repel their attacks by sticking together under one organization. I believe the FSC is that organization.

For the debaters, NO, I have no affiliation to the FSC, except as being their member. I just can't stand being put in a position by the government that makes me "Guilty until proven Innocent." That's bullshit!

I do appreciate the FSC heading up this fight. We need organizations that are designed to do just that.

However, I don't really like the idea of being on a list to will be given to a master which in turn is most likely choosen by the US government. They have always done what they wanted to and who is to say that they won't find a way to get the list opened. If thats the case, everyone on that list is a potential target. If you are trying to buy protection, then you are most likely not compliant and that's why you are doing it. If you are compliant, then you have nothing to worry about.

Just take the time and get your biz compliant. Newbreed has some cheap software that will make your work easy. We bought it and are more than happy.
