well it seems to me the easiest solution (for affiliates anyways) would be for each sponsor to have one url where all the 2257 info is contained. affiliates just link it up on every gallery and there you go. of course programs would still have to do all the work of getting everything in order on a single page. another idea would be some kind of global database where ppl just link up to so that you are covered no matter what sponsor you are pushing. i don't know, i could be totally wrong as i don't know that much about the whole thing but who knows, just a thought on a saturday night.

I'm an affiliate wm and am not spending money on an attorney - as stated before.. attorneys have fucked me harder than any inmate could in prison. I'll go all text. I really don't give a fuck about some bullshit completely unforceable law.

They can't be. Read the regs 3rd parties are NOT allowed. And No I never got legal counsol ebfore getting into this biz. Why would most do? Most of us start out aprt time withno clue if this is even going to turn into anything. So naturally waste hundreds of $ on an lawyer when you may not even make that much to begin with.

If someone was going to start their own PAY site or AFFILATE program or if they are going to incorperate themselves then yes I would recomend getting lawyer before starting. Just a Joe Blow maybe posting a couple of a galleries a week? Please.

Can't blame ya thongfile!! There is a "syndrome" about running along to an attorney to find an answer. The truth is they know little more than you do without extensive research - plus, because some asshole gets churned thru law school, does not grant him a superior judgement.

I could count on one hand the lawyers I'd trust - the rest, by far, are naive kids trying to earn a living.

One think ya gotta remember about content providers - many don't rely on the net for a living - they are better off working in other fields which most decent one's do anyway. Cheap net shoots are not their financial success stories when ad agencies pay em $10K upwards a day.

The other factor is... no reasonable photographer is gonna issue his model data to all and sundry - just ain't gonna happen even if there are data protection laws. Photographers have relationships with models (don't mean personal!) and they are not gonna screw that because of some foreign law.

This part of 2257 is not simply going to affect foreign shoots - can you see a model coming along to a shoot in Ohio to be told her home address needs to be distributed? They will run a mile! :-)

Yes, but it CAN be digital copy as long as it contains scans of the original docs. Those digital copies do however have to be located at the address you listed on your 2257 page.

All I know is the law says there has to be copies at your place of business. The one listed on your 2257 page. If the DOJ comes to your place for an inspection they expect you to have everything on hand.

I keep thinking about this DB idea...... what if I had a local ecrypted copy of the Db on my HD but I didnt have a PW for it.

The FBI comes to my property and says "I wanna see the docs"....I say "OK, call this number for a PW, and they, after verification will give you the PW".

Its on my comp and in my bus premises...... Is there anything that says I need access to the info?

The DB would be be the ez part I think.

Sheesh! So happens we are suing one now - a "proclaimed expert" who, tho I'm sure he does know of his field of expertise, - is just fucking incompetent.

There is no question of not winning - he knows it, we know it - it's just for the judge to mutter the words. The only "verbal" is from him trying to retain his status and credibility - he can keep that, - just compensate instead.

This was the second time ever in suing a lawyer - the first they actually admitted they screwed and invited us to sue (covered in legal insusurance) and we still use them to this day - mainly cos they were honest.

Damnation my head hurts after reading yet another 2257 post.
We dont operate out of the states - but do host their. Luckily we shoot all our own content and so have our documents in order. Any shoots from the early days that the documents were either badly written or shitty passport photos we dumped the content. Good to have a clean out every now n then.

This only left the problem for our affiliates - so we giving em a number of choices - promote from gear hosted on our servers - or we cut specific content complete with copies of the legal paper work. Dont take 5 minutes to grab n fax the fuckers. Sooner or later we could move to an Euro host , but most we have looked at dont seem to offer what the US still can.
So i say bring it fucking on - im soooooooooo fucking glad though our offices are based in Europe - and that we now have solid EU billing options ...

Let the drama unfold should be an interesting ride the next few weeks n months
