So basically with this rule you can shop online, purchase a product/service, give the merchant authorization to charge your card. Then they can keep your money, not provide the product/service, and ignore the banks???

Did that come from Visa or the issuing bank? An issuing bank would be shooting themself in the foot if they told you that.

I would fire the bank. There is enough proof out there that you got fucked over on the purchase. If they wouldn't go with fraud, they should have at least offered to look into the situation and come to a reasonable outcome with you.

According to Visa International Chargeback regulations, the issuing bank HAS to initiate a chargeback for either for "Services Not Rendered" (if the server was down for the entire month) or "Services Not As Described" (if the serve was up and down all month). This is regardless of whether or not an authorization was given for the charge.

Send your issuing bank a letter briefly explaining the situation. Include your card number and the dates your hosting was down for. They'll take action, but it might take a few months.


Not only is this policy enforced by Visa Int., it's also part of the Fair Credit Billing Act
