Correct.
According to Visa International Chargeback regulations, the issuing bank HAS to initiate a chargeback for either for "Services Not Rendered" (if the server was down for the entire month) or "Services Not As Described" (if the serve was up and down all month). This is regardless of whether or not an authorization was given for the charge.
Send your issuing bank a letter briefly explaining the situation. Include your card number and the dates your hosting was down for. They'll take action, but it might take a few months.

Fair Credit Billing Act
