Extreme Associates Case Dismissed

Yes, it's true. The case against Extreme Associates has been thrown out by the federal judge; all 10 counts dismissed. The federal obscenity statute was ruled unconstitutional. There may be appeals, but this is a day to rejoice.

My inside source tells me that a federal judge in Pittsburgh, PA threw the case out because the videos Extreme had been prosecuted over had been sent via mail order from an internet website - direct from Extreme - and the federal judge took issue with traditional obscenity tests of "community standards" being applied from the Pittsburgh community rather than from Extreme's own home community.

This is VERY good news for the entire industry when the feds want to attempt to bring obscenity prosecutions to website owners. I have always asked "what community standard will be applied?"

This federal judge could not determine the answer and had to dismiss the case on one of Extreme's motions to dismiss that the description of obscenity or the test for obscenity couldn't be applied because it was an internet transaction.

Personally, I can't believe Rob and Extreme won their case in this day and age, but maybe, just maybe, the sky is not falling...

this is great news. There had always been a question about community standards. Can a website own be prosecuted in a bible belt state if they lived in california ( for example) ? The prevailing logic had always been yes they can, but it looks like that is not the case. It always made sense to me that community standards don't apply in interenet cases because the community is not involved. This is a great ruling but if I remeber correctly the supreme court, when it last rules on COPA said that community standards can be used. It will be interesting to see how this will play out.

well personally, the extreme shit and max hardcore porn turns my stomach, but it is everywhere now---very hard to get a jury to convict any sort of consensual adult sexual activity as obscene in the USA.

after all, if the government can't get a conviction on extreme associates, where do they go from here?

just last year canadians dimissed a big case involving consensual bondage stuff and rough sex---same north american culture.

ordinary folks might think this sort of shit is nasty, but ordinary folks don't necessarily want a government dictating to them what they can watch in their own homes.

so now the same "moral majority" DOJ wants to play with 2257 laws and criminalize sloppy bookkeeping?

problem is, mandatory federal sentences guidelines have just been watered down.

so if no minor was actually exploited, i think it will be pretty difficult to criminalize an unintentional record-keeping error.

my bet is that smut isn't going away anytime soon...and the reason is this---too many ordinary people want it---and those people sit on juries.

This is a very mixed blessing for all the obvious reasons.

Personally I think the judge made the right decision, this isn't something that the federal courts should be involved in. The crimes that are being committed aren't related to the distribution. The crimes are assault and battery and such that should be prosecuted locally.
If L.A. County and porn valley cant rid themselves of the likes of this little piece of shit (Rob Black) then they deserve to have him.

certainly seems to insulate us from the feds a lot better

HUGE. I think this one is going to the Supreme Court, with ramifications for all.

Finally we are getting to the heart of the question surrounding obscenity laws, which is, does the state have a valid interest in what sexual acts go on in people's homes (or are viewed there) when everyone involved is a consenting adult and no one gets hurt?

Its very good news from a legal standpoint and certainly adds another layer of defense tactics adult industry attorneys can now add to their bag of tricks.

However if you guys think that's the end of it and now nothing else is going to go down you don't understand the mind set of the ultra right conservatives who control the US Department of Justice right now.

And I can only imagine the size of Rob Black's legal bills defending himself. Federal lawsuits at this level where you need teams of legal staff cost a bloody fortune.

So don't go to the beach now and think everyone can breath a sigh of relief. Its a victory for the porn industry but will just further the anti-porn crowd's resolve to figure out new angles of attack. These people have made it their mission to do anything and everything they can to stop porn.

My attorney called me as soon as he heard. He said it's far from over with obscenity prosecutions but is a definite step in the right direction. I agree with you 100% KRL.
I do feel though that this will blunt many attempts at obscenity prosecutions and the gubment will definatley be more tenative in their approach on this matter.
