Affiliates who steal pics and sponsors who don't care
I have a dilemma. I have been trying to get a hold of our friends at ARS about their partners stealing our pictures to promote their sites.
Here is an example http://teen.bestsexhost.net/hotteen4/teen4150.htm It is on their host, and pushing their site. However, even with our best attempts, ARS does not respond to us, or discourage their affiliates from using stolen content. Any suggestions? I don't want to start a war, but this shit is getting old. You are not on your own here, had the same problem with an Iteens gallery stealing some of my pics, got no solid answer from them. That was a little stupid of him to use Tawn , even I wouldn't steal her LOL. I am sure ARS will do something if they read this. |

They must get tons of cease and desist emails claiming to be copyright holders. How do they know their affiliate doesn't have a receipt for that set and your dispute is actually with a content provider? How would a sponsor know for a fact you and only you hold all rights?
Mail ARS photocopies of the evidence you are ready willing and able to present in civil court to prove your rights have been violated. Get the contact info for their affiliate so you can find out whether he is a lone wolf or whether a larger problem exists because he bought your pics somewhere. If after having been provided with proof ARS won't help you, burn 'em in court and set an example everybody else will fear and avoid. Works for me. Unless its on a grand scale where pics are being used in pay sites its not worth all the trouble chasing these cheats beyond hitting the services they use. Hell you could spend half your working day chasing these idiots. All this guy needs to say is he got his content mixed up "sorry" and your case has hit the deck.
He would get a much better result by using the correct sponsor for the stolen content, I doubt if he even knows about Tawneys site. |

However, drop onto the ARS webmaster board. It's pretty active, I'm sure that someone will notice you in there. Bug them until they get it sorted. That guy has probably taken Tawnee's pics from a gallery promoting her site, hence the name. Or maybe a gallery has been given a description with the name "Tawnee" on a tgp, the guy just surfed on into the gallery and raped the content. There's a million and one explanations for her name getting on there - this is fucked up. I'm sure it bothers you, bug ARS until they take it down. |

I think the best thing to do is boycot the idiots to who do this. In alot of cases its hard to tell. But if you run a tgp, linklist, etc and you see Len's content promoting something else its pretty recognizable. I believe this to be the case with Lightspeed content. Their conversion rates are awesome for that reason. So if you see this shit happening, don't list the guy. Blacklist his ass or something. People like this are the ones that make it tougher for the rest of us

Well I don't know about ARS.
Once I saw a motherfucker promoting Teen Dreamer on a gallery with a chick that had shirt saying pussyhigh.com on it -- obviously stolen pics. I didn't care that much, since I don't own or even promote pussyhigh, but I droped Laura (director of webmaster support) a line with the gallery URL She replied to me in less than 4 hours saying that the guy who was doing it had his account suspended WITHOUT PAY So you see it all depends how busy they are. Okay to address a few different issues on this subject.
First off BestSexHost is one of the offerings of the ARS webmaster program. We receivie NUMEROUS complaints daily, given the fact that it's the #2 freehost out there right now this is not suprising. We terminate all accounts with stolen/unlicensed content no questions asked. From a legal standpoint -- it's not ARS's job to terminate the affiliate, and for them or any other sponsor to do so is a courtesy to the copyright holder.
When an affiliate who doesn't actually have processing is using stolen content, going to their host is the legal way to shut them down. You fill out an affadavit and their host has to take action -- first by notifying the offender that they are using stolen content and giving them time (we use 24 hours at Cavecreek) to remove the material before the account is terminated. Stolen or unlicensed use of content sucks, there's no doubt about it -- we get many complaints daily between CCBill and Cavecreek. But to blame or boycott ARS for no valid reason, well, that's just wrong. |

What's the problem here? As SOON as this was brought to our attention we removed it. I don't have the time nor the resources to ask the thousands of accounts which pics they paid for and which they stole. That's asinine to think that a freehost would know which content was legal or not. I get 3-5 APIC requests a day, and all the accounts are terminated. That seems like a relatively low number to me based on the number of pages and to think I could have someone spending all day searching for those needles in a haystack, well... ------------------ ARS The 3rd Generation, Launching Oct 31st. |

oscer -- they did not take it upon themselves to police anything by starting a freehost and if you'll have a close look at DMCA you'll see that hosts can create liability for themselves very easily by attempting to police their clients. The copyright holder bears the burden of notification -- an affadavit that's acceptable under DMCA is presented to the host, the host notifies the offender and if the offender doesn't take down the stolen material or produce a license to use it in a timely manner, then and only then, can they be safely terminated from the host. I don't hold with stolen content, but I'm also hard pressed to find too many people in this industry that haven't violated licenses from time to time, even if it's just a paysite owner pushing feeds from a members area they license into another one of theirs or an associates that they don't license. |

if you get into the content business its YOUR business to protect your copyright. NO ONE ELSE'S.
As Kimmy says, its a courtesy for a sponsor to do this. if someone emails me about a copyright infringment, how the hell would I know if it was valid or not (I don't spend my day looking at porn) If I cancel their account do I pay them what's owed or not? If not, will the content provider pay my court costs when the webmaster accuses me of stealing his money? If I pay him and cancel his account, what is the point?
