Cops almost never charge you unless you are over 1.0 because it is almost impossible to prove that you were impaired if the reading is less because the timing of the breathalyzer reading comes into question. (Although this will depend on what you admitted to the officer during questioniing, and how long it was before you got the final readings done at the station.) For your sake, hopefully you didn't tell them how long ago you had your last drink. Definately get a lawyer, because unless you blabbed a lot to the cop, I think you will have no problem getting off the charge with only a .83. Unfortunately, that's just the way the system works. |

There is a reason why DUI is a misdemeanor and DUI with Injury is a 3rd degree felony.
With a 0.83 blow the fact is that this DUI charge is very suspect and it could very easily have been that he was under .80 when he was arrested. Alcohol absorption in the human body looks like a bell curve and its very possible he was tested near the peak of his intoxication. What if he really was a .78, which doesnt even support a misdemeanor charge? Would you be so gung ho to call him a criminal? Your assuming guilt and then taking it one step further by freely comparing him to acts that are not even in the same class of crimes. |

Don't sweat it dude....I got one when I was 22, (my only one). Everyone is a hypocrite when it comes to DUI. I think it is the #1 thing people say don't but do. I know a lot of people that have them and some of them are the most upstanding people you will ever meet. Just make sure you are smarter now because you only get one chance-

However millions of people do it, some regularly. Statistics I was shown by a police chief estimated that it takes 90+ times of driving under the influence to get caught. Some people get caught after 200, and some after only 1. This is a bottomless topic and would be better left alone. (Everyone knows it is wrong, and insulting someone for screwing up doesn't help the person change and move on). |
