Since I see you are in Toronto, I will give you an idea of what you are in for, since Ontario now has some of the toughest laws for first offences in the world:

- 3 months with no license whether you are found quilty or not
- $700 for a lawyer if you just want him to review the case and then plead guilty. ( you could just go with duty counsel, but that's not advisable)

After you are found quilty you can look forward to:
- car insurance will probably be close to $400 a month, if you can even get it, and it stays like that for up to 3 years
- $550 education course mandatory
- $650 fine, but if you get a "hanging" judge it could be as high as $2000 or so
- 1 year driving prohibition mandatory
- After your one year of driving prohibition, you are required to put an ignition interlock device in your car for another year if you want to drive. (Otherwise you will have 2 years driving prohibition) You have to blow in it every time you start your car, and in random intervals after that (anywhere from every 5 to 30 minutes) while you are driving.
You can't drive any vehicle that doesn't have one of these installed, so forget about driving anyone else's vehicles, or if you have multiple cars, then expect to pay double
This device costs you about $1400 installed, and they take it back after the year is up.

Have fun!

Facts about .08:

* At .08, all drivers are impaired to the point that critical driving skills are greatly diminished. Studies indicate that at a .08 BAC level, a driver?s steering, braking, speed control, lane changing, gear changing and judgments of speed and distance are all significantly impaired.

* To reach .08, a 170-pound male would have to consume four or more drinks in a one-hour period on an empty stomach. A 137-pound female would have to consume three drinks in one hour to reach .08. A drink is considered a 12-ounce beer, a 5-ounce glass of wine or a cocktail containing 1.5 ounces of 80-proof liquor.

* At .08, a driver is three times more likely to be involved in a car crash than a sober driver, and 11 times more likely to be killed in a single-vehicle crash.

That's a stupid mistake.

Drinking and driving has potentially lethal consequences. A little outside the "stupid mistake" realm, especially when that mistake ends in a fatality.

I am not saying I believe DUI is not a crime, it clearly is, but here you are comparing two different classes of crimes. DUI that results in injury is a felony much like if you had simple math errors that resulted in injuries or death would also land you in court on a felony homocide charge.

You are treating this person like a real criminal rather than someone who just screwed up and will probably not do it again.

SAD

I just seen you said you blew a .83. This will be very hard for them to convict you on.

Cops almost never charge you unless you are over 1.0 because it is almost impossible to prove that you were impaired if the reading is less because the timing of the breathalyzer reading comes into question. (Although this will depend on what you admitted to the officer during questioniing, and how long it was before you got the final readings done at the station.)

For your sake, hopefully you didn't tell them how long ago you had your last drink.

Definately get a lawyer, because unless you blabbed a lot to the cop, I think you will have no problem getting off the charge with only a .83.

Unfortunately, that's just the way the system works.

There is a reason why DUI is a misdemeanor and DUI with Injury is a 3rd degree felony.

With a 0.83 blow the fact is that this DUI charge is very suspect and it could very easily have been that he was under .80 when he was arrested. Alcohol absorption in the human body looks like a bell curve and its very possible he was tested near the peak of his intoxication. What if he really was a .78, which doesnt even support a misdemeanor charge? Would you be so gung ho to call him a criminal?

Your assuming guilt and then taking it one step further by freely comparing him to acts that are not even in the same class of crimes.

evanmorgan 12-14-2004 02:32 PM

i dont think you should be drinking if you are going to drive

ive talked to alot of officers and they always sit in hotspots, like outside clubs, strip clubs and on main roads out of downtown.

they are not stupid, they laught at people like you that play into their hands, use your fucking brain.

22 is very young, especially when you act like a spoiled brat.

You're fucking lucky all you got was a DUI. If you had been in an accident and hurt or killed someone you'd be headed to jail right now.

Learn your lesson and grow up. This is your chance.

Don't sweat it dude....I got one when I was 22, (my only one). Everyone is a hypocrite when it comes to DUI. I think it is the #1 thing people say don't but do. I know a lot of people that have them and some of them are the most upstanding people you will ever meet. Just make sure you are smarter now because you only get one chance-

Don't even know why there is a arguement here.
Drinking and driving is against the law.
plain and simple. just dont do it.

MT_Butterfly 12-14-2004 04:29 PM

Consequences for bad choices usually aren't the most enjoyable thing in the world. BUT, you made the choice to drink and drive so now you need to accept responsibility for your actions and deal with it.

Just be glad you didn't kill someone.

ProjectNaked 12-14-2004 04:30 PM

DUI IS WRONG AND AGAINST THE LAW!

However millions of people do it, some regularly. Statistics I was shown by a police chief estimated that it takes 90+ times of driving under the influence to get caught. Some people get caught after 200, and some after only 1. This is a bottomless topic and would be better left alone.

(Everyone knows it is wrong, and insulting someone for screwing up doesn't help the person change and move on).

sandman! 12-14-2004 04:32 PM
