BMW is sueing AskJolene because they list galleries which contain nudity/sex with BMW cars in the pics...

why wouldn't they do the same with a content producer?

That is my thought as well. If Disney can sue for that, wouldn't that make it possible for companies like Victoria's Secret to sue if they see their product being worn in a shoot?

Granted they are different. But making it ok for one would be making it ok for all. The precident would have been set. A company can sue someone who bought their product because they don't agree with the way it was used.

They can if the product has branding which is visible, or within the main focus of the picture... why do you think you dont see any brand names on some tv shows.

We will probably see one soon, I'm not sure where the AskJolene/BMW AG case is at the moment but I think they will go to court.

Mind you this case is even a step further, they're sueing the ones that offer results on pics with certain product brands in them

It is far from clear. Until there has been a legal case at a high level, no one can say they know what the outcome will be.

Disney has deep pockets, and I am sure will go after anyone showing pics of their images in porn. After all, they appeal to kids.

I chatted casually with a lawyer about this. He emphasised a final court case would cost well into 6 digits.

But he ventured the opinion that showing a product being used as it is intended to be used, is way more defendable than using it in an inappropriate manner.

Show a girl using a barbie doll as a dildo, and your case is pretty weak.

Showing a girl being interviewed and talking about why she is getting into porn, and having her refer to a copy of Hustler magazine, you may be pretty safe.
