Clearly this idiot knows nothing and will end up getting you sued.
He has no issues about stealing other peoples work for his profit.

He's not going to get sued because he shot porn in which some Disney sheets were present.

You still need those TGP layouts for that program you're working on?

lol you clearly didn't read about the AskJolene/BMW AG case?

BMW is sueing AskJolene because they list galleries which contain nudity/sex with BMW cars in the pics...

why wouldn't they do the same with a content producer?

TheLegacy 11-02-2004 11:57 AM

interesting arguement here.. I thought it was once you bought the sheets then they become yours - they waiver all rights nor is there a disclaimer when you buy the sheets.

That is my thought as well. If Disney can sue for that, wouldn't that make it possible for companies like Victoria's Secret to sue if they see their product being worn in a shoot?

I think you should contact a lawyer before making any legal decisions.

Granted they are different. But making it ok for one would be making it ok for all. The precident would have been set. A company can sue someone who bought their product because they don't agree with the way it was used.

One lawyer will tell you this, the next one this. Hey Paul, have you hear of O.J. Simpson? Where were you on the day he was set free? And there you go with lawyers. How about focusing on the quality of this content? Can you actually jerk off to it?

They can if the product has branding which is visible, or within the main focus of the picture... why do you think you dont see any brand names on some tv shows.

Do you have an example of this having been ruled on in a court...anywhere?

This is a good discussion here. I'm almost to 10k

We will probably see one soon, I'm not sure where the AskJolene/BMW AG case is at the moment but I think they will go to court.

Mind you this case is even a step further, they're sueing the ones that offer results on pics with certain product brands in them :2 cents:

Meaning of COPYRIGHT

[n] a document granting exclusive right to publish and sell literary or musical or artistic work
[adj] (of literary or musical or dramatic or artistic work) protected by copyright; "permission to publish copyright material"
[v] secure a copyright on a written work; "did you copyright your manuscript?"

Here is a perfect situation, Hustler releases a magazine... IF you took pictures of the magazine and published them do you think you could be sued? Of course you could....the mouse is no different.

That would be akin to me taking Minnie Mouse and making my own sheets to sell.

That's a lot different than me as a consumer, buying their product and using it in a fashion that they don't necessarily approve of.

He's not making money off of Disney or any Disney product.

It is far from clear. Until there has been a legal case at a high level, no one can say they know what the outcome will be.

Disney has deep pockets, and I am sure will go after anyone showing pics of their images in porn. After all, they appeal to kids.

I chatted casually with a lawyer about this. He emphasised a final court case would cost well into 6 digits.

But he ventured the opinion that showing a product being used as it is intended to be used, is way more defendable than using it in an inappropriate manner.

Show a girl using a barbie doll as a dildo, and your case is pretty weak.

Showing a girl being interviewed and talking about why she is getting into porn, and having her refer to a copy of Hustler magazine, you may be pretty safe.

1) You didnt answer my question about Hustler...Is it legal to take pictures of all the pages of the magazine and publish it? You did buy the magazine after all

2) What do you possibly have that i could be envious of?

3) I dont need a lawyer to tell me that copying artwork for which a copyright exists (and possibly a trademark) that you do NOT have a license for is illegal.

Let me ask you something idiot...What if i bought a membership to one of the sites which has your content and downloaded everything to use on my paysites and galleries? I did buy a membership to the site...does that mean i can use whatever i want from the site for whatever i want?

USing this example, would the show be allowed to reproduce the hustler artwork/magazine without prior concent from Hustler?

I do not have to answer your questions. Listen, this issue here is reallly relative and if we go to a lawsuit, the person that has more money will win (O.J.Simpson).

My point is that you starting a thread alleging someting whereby there is at least a 50% probability that you are wrong, maybe even higher. Why don't you talk to a fucking lawyer before accusing people if you are not sure, you dumb fuck.

This thread is finished for me, it just proved to me that one has to take GFY really easy :321GFY

He's not making money off of Disney but he is making a relation between the innocent Minnie Mouse product and a porn shoot.

This could well be a reason for Disney to sue and I wouldn't find it odd if they won. Eventually they have the longer breath coz of the deep pockets.

This all is in my view as a lawstudent
