This is a major victory for the defendants as everyone has been waiting to see the outcome.

The Defense Group still needs your support.. there is still legal fees to pay to push the nail into coffin.

The example that will be set here is don't come to the adult biz if you want to troll your patent...

Corporate america (especially publically traded companies) have shown the new trick of doing the patent rollover.

Support the Defense Group, now is the most crucial time to jump in.

Offer your support:
Spike: (949) 716-8080. Contributions can also be sent to: Acacia Joint Defense Group, c/o Spike Goldberg, New Destiny, 27111 Aliso Viejo Rd., #180, Aliso Viejo, Calif. 92656.

Is this thing still years away from completely being settled? I keep hearing that Acacia is on the verge of getting class action status against all adult webmasters, and that once this happens they will sue everyone. I really don't want that to happen. I just want them to die and go away quickly.

No, final nail should be hammered in by the end of the year.

The class action hearing was supposed to happen on July 7th.. the judge postponed it.. i reported about it on my website in guess that the judge was finding his rulings on the claims to not be in favor of acacia, thus the need to postpone the class action.

With this Markman Order, the guess was right. There won't be a class action..

I know that brutha baddog shares in the good news, and is trying to bring balance to the excitement.... the battle is certainly not over, and Acacia can put up legal roadblocks to drag the final resolution into 2005..... so again, support the defendants by supporting financially and/or joining their affiliate programs.

Sales for them, means money in your pocket, as well as additional money to keep driving the stake.

No a realist.

It's the truth..that's how these things work.

Ever been through a divorce or been in a car accident and had to sue the other person...jeez those alone can take 6 months to 2 years +.

boobmaster 07-12-2004 09:29 PM

To any day traders in here, Acacia's stock might be a good one to short tomorrow.

dicknixon 07-12-2004 09:36 PM

Though it might take a lot of time for the case to end, one thing is clear. The defendants are winning this case. Maybe if Acacia's stock holders get news of this they will try to stop the company from spending the last of it's warchest on a "losing battle" . . .

Just an optimistic thought . . anyway I have to say one more time:

Thank you Spike & The Defense team!

Time to open that bottle of blue label . . . :)

WTF is a pessiment? My excuse is that I am old, and I have been involved in legal proceedings longer than I care to remember.

Like Brandon said, I share the good tidings, I just don't like to count my chickens before they are hatched.

People get too excited, they think it is all over except the crying and get apathetic. Would hate to see that happen at this point in time.

He thought his $300 a month was a cheap out, maybe he will not think this in 5 years time, when he's flipping burgers or still paying out.

The licensees agreed to the validity of the patents, unless it's completely over turned they have to keep paying. This ruling might be that is doesn't apply to the defendents and that will stuff those who sold out.

Guess it sucks to be a licensee.

Even a little one.

undermyspell 07-12-2004 10:11 PM

AdultGrind's view on the article...

It seems that whoever was researching the various meanings of phrases and words in question in Acacia vs. New Destiny relied heavily on Webster?s dictionary for the precise definitions.

In a 40 page ruling handed down today by Judge Ware it spelled out the various items and pieces of the patent claims that were in question and identified what the plaintiff (Acacia) believed was the correct way to interpret and what the defendant (New Destiny) believed was the correct interpretation.

Rest of the Story Here
