Legality of celeb sites (anybody with info please respond)

I was hoping that some people here could point me in the right direction as to where I could read up on the legality of celeb sites. What I can and can?t do, where to get my content, etc.

I tend to shy away from the more risqué parts of adult, and as of now I consider celebs to be in that mix. However the sheer volume of search engine traffic for celeb related searches makes me feel like I?m leaving money on the table by not promoting it? but at the same time the last thing I want is a potentially disastrous law suit from a celebrity because I do already have quite a good thing going for me....

Anyways, I would appreciate any ** good information and recommendations ** that you all could provide me on this matter.

Yup, that's a right consideration, there may be a difference is fake and real celeb content, but in general it's a niche I wouldn't dare to touch...I prefer to earn cash I can spend myself instead of making my lawyer happy.

kush, our sites are 100% licensed - our partner is a large paparazzi agency with photographers all over the world - they provide the content, we build the sites.

We've got a basic list of rules that we've agree upon with them based on potential legal issues from the celebrities ... but most of the potential legal problems with celebrity sites are from photographers and owners of trademarks (& names).

In the case of a site like Mr Skin, pr companies for movies *want* them to be in there, so they turn a blind eye to the 'grey' licensing area because the publicity *far* outweighs the loss. I've watched the site evolve over the years from a totally not legal archive of movie clips to an in demand media outlet for celebrity news. Hank, as you mentioned - you even have companies sending you stuff now?!?! awesome ;-)


Here's my top 'what NOT to do if you want to be legal' ...

1) Don't make false claims. eg: 'britney is drunk' = bad ... 'britney is drunk?' = grey ... 'britney goes wild' = passable. Same goes for 'click here for britney sex tape'. THERE IS NO BRITNEY SEX TAPE!!!

2) Don't use names like 'playboy' ... 'alyssa milano' (psycho mother) LOL ... or any other 'name' which is known to send lots of c&d's. If you really want to mention a celebrity name, put it into content - ie, write some paragraph text.

3) Fakes, porno sites etc are the riskiest. IF a celebrity is going to sue for offensive or untrue material, they will start with "Ally McBeal takes a 10 inch cock" & similar. State clearly somewhere on the site its fake if you go this road.

4) Using photos scanned from magazines or taken from other websites is breaching the photographers copyright on the images. The chances of you being found are probably slim - but you just never know!

Make your pages informational not just pic galleries.

Make your links something link 'For nude news on Jalo' not 'Jalo naked' etc...

When you are SOE'ing use real info not just jibberish.

Never use stars name in bad light.

Never use fake pics.

Uses pics from movies not pics that star or photog own.

Using text links like "click here for britney sex tape" is perfectly legal. There are probably hundreds of britney sex tapes out there.

Best to keep to just Britney, then show them a Britney Smith or Jones, Speers might get you a lot of hassle from lawyers. Don't forget, he with the biggest wallet wins the most justice in the US.

CJ_Purve thanks for the raves...but you have got one thing wrong here...We have always been legal in what we do because what we do falls under fairuse of the copyright law. We are like Roger Ebert and anybody else who writes about movies who uses pics and clips to support their ratings and reviews

Papazzi sites brings in a different set of issues in that they are unlicensed pics of stars taken usually without their permission. We stay away from any unlicensed pics so I don't know much about how laws pertaining to them

Here is an example of a link where you guys try to get slick and we get fucked everytime. Everyone knows what you are trying to do and we get nailed everytime. IT IS WRONG BECAUSE IT IS DECEPTIVE...

Britney Spears has never done a sex tape and you are trying to play off her popularity to get SE traffic etc. You will get nailed by the star and you will get chargebacks from people looking for a Britney Spears sextape. Not good

First one is wrong because britney spears has not done a sex tape. Even if she had, it is still wrong if she had done one if it's an illegal unlicensed tape.

The second is OK if britney speers is a real person who did a sex tape.
