1) Wrong? Depends what your goals are here. But on this particular note, talking about the sponsor in an open forum without mentioning who it is, helps no one. Obviously, it's helps Jact when they show the sponsor this thread..that goes without saying. People who know who it is, good for you. People who don't want to pull their links so they don't get fucked. Same thing happend with PIB. Obviously, Jact won't post while they're in negotiations.

Hopefully they'll come to their senses, but I sure as fuck wouldn't risk my partner accounts over these numbnuts. Yes, even if that meant leaving the galleries be and sending them even more sales.

Exactly. I don't know what the dialogue is between Jact, LM and this sponsor, but this is about the best advice I've read here so far, it's what I would do. It's one thing to discontinue any new promotions of them at their request, but it is quite another to have the rest of your business damaged over this one idiot sponsor.

I hope they pay up, but if they don't come to their senses then I can't wait to read about who it is. I can see dozens, if not hundreds of webmasters pulling their links, as well they should. No one sponsor anywhere is too valuable that some other sponsor can't just as easily take their place.

I agree to a point. As partner accounts become harder and harder to get, it's not worth it. But at the same time, instead of emailing tons of tpgs with an explanation, email the important ones that send huge traffic so at least you can get the galleries off those ones. Concentrate on a few and opposed to all of them. As for the rest, don't know...leave them as blueboy mentioned.

The pay is secondary to our business. That is exactly what this is, business, this isn't the schoolyard, you don't say it's okay for affiliate A to use the content and you say it's okay for affiliate B to use the content then go and tell affiliate A that you don't want them using the content anymore and please remove it immediately or we'll lock your account isn't exactly fair, when affiliates B - ZY497B are still allowed to use the content.

Maybe it's a respect thing? A wanting to be treated fairly thing? I don't know. I'm rambling now.

Well this is it too.. Should we be made to pay for use of content that we are not the only ones using? If this is the case, ALL their affiliates should be required to discontinue use of the content. Why isn't that happening?

I run a few TGP/MGPs and would be pissed if I found a shit load of 404s, but I would just delete the links and forget about it. But that's me.

The weirdest part is that they WANT them to continue to promote them afterwards - which is quite blatant if you ask me - first you screw me over with no lube, then you expect me to suck you dry.....doesn't make sense.

Anyhow, if you care to give better details of their plan, jact or LadyM.....

1) Are they paying you for the 500 sales?
2) Will they pay you for the rebills?

As everyone said, the simplest thing is to let your galleries stay rather than lose your partner accounts - but as I understood it, they don't want those images online, right? So it's not like you have much of a choice - either that or risk them 'accusing' you of unauthorized use of their content?

Yes, they were implying it was obtained in a way that was unacceptable, when in face this is not the case. Unfortunately it would be a relatively serious thing to remove the galleries frivilously, one that would cost us far more than the revenue generated.

Oh no, the images are online in their members areas. Someone in their operation is under the impression they are not released and that I obtained them inappropriately. Any joe with a password could see that this is not the case. There are other issues but they're really not worthwhile mentioning. They are relatively trivial. This situation, however, I believe the gravity of the request, especially considering the context, is more serious than they realize.

Out of curiosity, once this settles, what content will you be using to promote them (if you so decided to do so)?

OK, I'm trying to think this thing through.

The partner accounts are your first priority. The way to protect them is, leave the galleries up. That's EASY.

The sponsor/content provider wants you to take the galleries down. So?

If you are using their content pursuant to their guidelines, you have a licence. They tell you to pull the content, just say "Sorry, that would have commercially unacceptable consequences for us, we won't do it."

What are they going to do? Send you a DCMA "Notice and Take Down"? So send 'em an "I have the right to this content" DCMA counter-notice. Your hosting provider, if he's good, will honor your counter-notice, and you'll be good until the sponsor sues you.

When he does, so what? He'll try to establish actual or statutory damages, you'll try to establish that you had a licence and so no damages are due. It sounds like this dispute is worth some lawyer fees. At some point during this process, your lawyer can point out to their lawyer the economic value of your partner accounts, and explain that if they terminate your license without cause, they will be liable for the damages you suffer. Odds are, your potential damages are at least as big as the damages they could recover in a copyright suit, even if they could win one.

So what am I missing? If the partner accounts are the priority here, tell your sponsor to go fuck himself, and let the lawyers sort it out. The volume of business you are talking about, it sounds like a no-brainer to me.

I'm so sorry to hear you guys are still fighting this. What a nightmare! You should be getting fruit baskets, not ridiculous demands.
