Sec. 2256. - Definitions for chapter

''child pornography'' means any visual depiction, including any photograph, film, video, picture, or computer or computer-generated image or picture, whether made or produced by electronic, mechanical, or other means, of sexually explicit conduct, where -

(A)

the production of such visual depiction involves the use of a minor engaging in sexually explicit conduct;

(B)

such visual depiction is, or appears to be, of a minor engaging in sexually explicit conduct;

(C)

such visual depiction has been created, adapted, or modified to appear that an identifiable minor is engaging in sexually explicit conduct; or

(D)

such visual depiction is advertised, promoted, presented, described, or distributed in such a manner that conveys the impression that the material is or contains a visual depiction of a minor engaging in sexually explicit conduct; and

(9)

''identifiable minor'' -

(A)

means a person -

(i)


(I)

who was a minor at the time the visual depiction was created, adapted, or modified; or

(II)

whose image as a minor was used in creating, adapting, or modifying the visual depiction; and

(ii)

who is recognizable as an actual person by the person's face, likeness, or other distinguishing characteristic, such as a unique birthmark or other recognizable feature; and

(B)

shall not be construed to require proof of the actual identity of the identifiable minor

The law is still 18.

Right the law states that the child is still a minor and needs Parental Consent. A 16 year old is not old enough to enter a legal contract and that is what a model release is.

In Canada, where I am, you can gang bang a 14 year old girl, and unless you are in a position of authority, such as a teacher, you are breaking no laws. (assuming she is consenting, of course).

But take a porn picture of a girl, 18 yo less a day, and it is kiddie porn. Consent cannot be given to the filming, even by her parents. Possession is a serious crime. As soon as you press the record button on the cam, you are in deep dodo....

What is "porn" vs "art" is a subjective call by the police and the courts. I am paranoid enough that I don't shoot anyone less than 18, at all. Even family wedding pics....

Here are the hard facts from someone who lives in the UK and shoots his own content:

Prior to May 2004 a girl of 16 could pose for nude photo's if her parents were present at the shoot and gave their written consent. It was illegal to pose for porn under 18.

Since May 2004 it is now illegal for under 18's to even pose topless or appear semi clothed, as in ligerie, provocatively and the parents can no loonger sign their consent..

Where the UK is a real arse is that this law is retroactive. This means that anyone found in posession of topless or nude images of models under 18, even if shot before May 2004, when it was legal to do this face legal action.

A model release is not a legal document. This is to show that the model consented to the shoot and gives over all claims to rights of the images from the shoot to the photographer.

I heard some months ago that it was legal for topless (only) photos of 16-17 year old girls to be published in newspapers. I guess the newspaper only requirement was to limit the spread of the material outside of the UK where the laws obviously differed.

If this retroactive law applies then anyone who has an old paper lying around is now in possession of CP?

I did a google search for "UK topless 16 year" or similar to try to find info on this, but all I got returned were pedo site results.
