Is there a REAL Texas law like this dumb shit I was just told?

A friend of mine moved to Texas and she said awhile ago that her babydaddy was going to leave.

I ask her today and she says that she isn't allowed to kick him out because once a guest stays past three days, he is a legal resident of that home and you must give him a 30 day notice to vacate the premises..

She says she called the cops and they wouldn't make him leave because of this law. His name isn't on the lease or anything. He's just a GUEST.

So you mean to tell me that I can come stay as a guest at somehahahaha's house in Texas and on the 4th day, I can refuse to move out of there and they can't do anything about it?

That sounds like bullshit to me.

It's 30 days in most states. If someone stays with you for 30 days you cannot kick them out without a eviction. If you lock them out they can call the police and be let back in. Also if there is a relationship between the two parties for 90 days either party can sue for common law marriage which means divorce.

NO SHIT!

This is hardly ever enforced because most people have the common sense to just move on.

There are actual laws similar to that in many states. They have loopholes though. He's only a resident until he leaves, at which point she can change the lock and remove his belongings and he no longer lives there. The only way he can stay if he absolutely refuses to leave the house for any reason.

I recently ran into another fucked up law in Washington...
Apparently fathers have no parental rights. My ex-mother-in-law kidnapped my daughter and the police and courts told me that only my wife could file a complaint for the police to remove my daughter from the house.

90 days for common law marriage? I highly doubt that. Most states that still abide by common law marriages consider it a marriage after 7 years of continued residence.

I was also just informed by a lawyer friend that the Texas law for residence only applies if the person has established his residence. IE, he has to show the police mail with that address and his name or an identification card listing that address.
