Is there a REAL Texas law like this dumb shit I was just told?
A friend of mine moved to Texas and she said awhile ago that her babydaddy was going to leave.
I ask her today and she says that she isn't allowed to kick him out because once a guest stays past three days, he is a legal resident of that home and you must give him a 30 day notice to vacate the premises.. She says she called the cops and they wouldn't make him leave because of this law. His name isn't on the lease or anything. He's just a GUEST. So you mean to tell me that I can come stay as a guest at somehahahaha's house in Texas and on the 4th day, I can refuse to move out of there and they can't do anything about it? That sounds like bullshit to me. |
yea, its bullshit...:)

thats shitty..think its the opposite everywhere else

There are actual laws similar to that in many states. They have loopholes though. He's only a resident until he leaves, at which point she can change the lock and remove his belongings and he no longer lives there. The only way he can stay if he absolutely refuses to leave the house for any reason.
I recently ran into another fucked up law in Washington... Apparently fathers have no parental rights. My ex-mother-in-law kidnapped my daughter and the police and courts told me that only my wife could file a complaint for the police to remove my daughter from the house. |
I'm wrong about the common law marraige; it doesn't require 30 days! it can be one day in Texas if the following are met:
http://www.co.travis.tx.us/dro/common_law.asp Q: What makes a common law marriage? A: Three elements must be present to form a common law marriage in Texas. First, you must have "agreed to be married." Second, you must have "held yourselves out" as husband and wife. You must have represented to others that you were married to each other. As an example of this, you may have introduced you partner socially as "my husband," or you may have filed a joint income tax return. Third, you must have lived together in this state as husband and wife. |
but, in texas you're allowed to tote a pistol so if that chick is feeling froggish you might get a slug in yo ass :2 cents:

I was also just informed by a lawyer friend that the Texas law for residence only applies if the person has established his residence. IE, he has to show the police mail with that address and his name or an identification card listing that address. |
